   An act to amend Section 8506.2 of the Business and Professions
Code, relating to structural pest control.

   AB 1874, as introduced, Wood. Structural pest control.
   Existing law defines, licenses, and regulates structural pest
control operators and creates the Structural Pest Control Board in
the Department of Consumers Affairs to administrate these provisions.
Existing law defines a registered company to be specified types of
business organizations registered with the board to engage in the
practice of structural pest control, and defines a "qualifying
manager" as the licensed operator or operators designated by a
registered company to supervise the daily business of the company and
to be available to supervise and assist the company's employees.
Existing law prescribes 3 different classifications of structural
pest control licenses, which are termed branches, based on the types
of pest control work permitted. Existing law makes a violation of
provisions regulating structural pest control operators a
misdemeanor.
   This bill would revise the definition of "qualifying manager" to
require that the licensed operator be physically present at the
principal office or branch office location for a minimum of 72 hours
every 3 consecutive calendar months, and to require that these hours
be documented and provided to the board upon request.
   By expanding the definition of a crime, this bill would impose a
state-mandated local program.
   The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that
reimbursement.
   This bill would provide that no reimbursement is required by this
act for a specified reason.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 8506.2 of the Business and Professions Code is
amended to read:
   8506.2.  A "qualifying manager" is the licensed operator or
operators designated by a registered company to supervise the daily
business of the company and to be  available to supervise and
assist the company's employees.   physically present at
the principal office or branch office location for a minimum of 72
hours every three consecutive calendar months to supervise and assist
the company's employees. These hours shall be documented and
provided to the board upon request. 
  SEC. 2.  No reimbursement is required by this act pursuant to
Section 6 of Article XIII B of the California Constitution because
the only costs that may be incurred by a local agency or school
district will be incurred because this act creates a new crime or
infraction, eliminates a crime or infraction, or changes the penalty
for a crime or infraction, within the meaning of Section 17556 of the
Government Code, or changes the definition of a crime within the
meaning of Section 6 of Article XIII B of the California
Constitution.
