SUBJECT: State real property: reversion
DIGEST: This bill authorizes the Director of the Department
of General Services (DGS) to revert a specified parcel of state
real property to the City of Buenaventura.
ANALYSIS:
Existing law:
1)Requires DGS to provide planning, acquisition, construction,
and maintenance of state buildings and property, and maintain
a statewide property inventory of all real property held by
the state.
2)Provides that DGS may acquire and dispose of surplus state
real property where that property is not needed by another
state agency and the Legislature has authorized disposal of
the property.
This bill authorizes the Director of DGS to revert a specified
parcel of state real property to the City of Buenaventura.
Background
Purpose of the bill. In 2003, the City of Buenaventura and the
State of California Department of Veteran's Affairs (CalVet)
entered into an agreement that deeded land to the state in order

to allow the state to build a veterans' home. At the time, the
state had funding to build a 100-bed facility. However, there
was a possibility that more funding would become available and
thus the deed contemplated an expansion of the facility onto an
additional 11 acres. If the state did not build this expansion
by 2020, the 11 acres would revert back to the City. Currently,
the state has no plans or resources to build an expansion. The
City would like this property back as soon as possible so that
they can compete for Prop 41 funding to build veteran housing.
CalVet and DGS are currently working with the City to change the
terms of the deed.
The bill simply causes the reversion to happen as soon as the
bill takes effect, rather than waiting until 2020 for the
initial agreement to expire.
Prior/Related Legislation
AB 2904 (Accountability and Administrative Review Committee,
2016) authorizes the Director of DGS to dispose of a specified
surplus property, known as the California Highway Patrol field
office in Stockton, California. (Pending in Senate
Governmental Organization Committee)
AB 2174 (Accountability and Administrative Review Committee,
Chapter 337, Statutes of 2014) authorized DGS to dispose of
seven surplus state properties.
AB 826 (Jones-Sawyer, Chapter 505, Statutes of 2013) authorized
DGS to dispose of eight surplus state properties including the
EDD's office building in Vallejo, California.
