The Freeway Service Patrol Act authorizes and provides funding for freeway service patrols, operated pursuant to an agreement between the Department of the California Highway Patrol, the Department of Transportation, and a regional or local governmental entity, on traffic-congested urban freeways throughout the state.

This bill would, by June 20, 2018, and every 5 years thereafter, require the Department of Transportation to publish and submit to the Legislature and the Department of Finance, as specified, a statewide Freeway Service Patrol Program Assessment that would, among other things, identify, quantify, and analyze existing freeway service patrols, identify opportunities to increase or expand service levels, and analyze and provide recommendations regarding the current and anticipated future financial condition of the program, as specified. The bill would require the state budget to include a line item identifying the amount of local assistance moneys and state operations moneys that were provided in support of freeway service patrols.

This bill would require, no later than June 30, 2017, and every 2 years thereafter, the Department of the California Highway Patrol, in coordination with the Department of Transportation and in consultation with regional and local entities, to complete a workload study to assess resource needs to supervise existing and expanded freeway service patrols identified by regional and local entities and to submit the study to the Senate Committee on Budget and Fiscal Review and the Assembly Committee on Budget. The bill would also require the departments to prepare their annual budget requests to the Legislature to accommodate the Department of the California Highway Patrol’s oversight of increased freeway service patrols identified in the study.

(a) By June 20, 2018, and every five years thereafter,
4the department, in coordination with the Department of the
5California Highway Patrol and regional and local entities, shall
6publish a statewide Freeway Service Patrol Program Assessment.
7The program assessment shall do all of the following:

(1) Identify, quantify, and analyze existing freeway service
9patrols, and identify opportunities to increase or expand service
10levels.

(2) Analyze and provide recommendations regarding the current
12and anticipated future financial condition of the program,
13accounting for various factors, including, but not limited to,
14operation costs, available funding, and state personnel resources.

(3) Examine all of the following:

(A) The financial sustainability of maintaining current freeway
17service patrols.

(B) The route miles unserved or underserved by freeway service
19patrols.

(C) Historical, current, and future state and local funding for
21freeway service patrols.

(4) Analyze and quantify the public benefits received or to be
23received from existing and potential new freeway service patrols.

(5) Discuss how freeway service patrols relate to other state
25policies, plans, and goals.

(b) The department shall submit the program assessment to the
2Legislature, in compliance with Section 9795 of the Government
3Code, and to the Department of Finance, and shall include a
4recommendation regarding the state moneys necessary to fund the
5recommendations identified in the program assessment.

SECTION 1.  

Section 2566 is added to the Streets and Highways
13Code
, to read:

2566.  

(a) No later than June 30, 2017, and every two years
15thereafter, the Department of the California Highway Patrol, in
16coordination with the Department of Transportation and in
17consultation with regional and local entities, shall complete a
18workload study to assess resource needs to supervise existing and
19expanded freeway service patrols identified by regional and local
20entities. The study shall do both of the following:

21(1) Identify potential additional freeway mileage that could be
22served by new freeway service patrols, as recommended by
23regional and local entities, that have a reasonable expectation of
24meeting the eligibility requirements of this chapter and current
25program guidelines.

26(2) Identify additional Department of California Highway Patrol
27resources needed to supervise additional freeway mileage identified
28in paragraph (1).

29(b) The Department of the California Highway Patrol shall
30submit the study to the Senate Committee on Budget and Fiscal
31Review and the Assembly Committee on Budget.

32(c) The Department of the California Highway Patrol and the
33Department of Transportation shall prepare their annual budget
34requests to the Legislature to accommodate the Department of the
35California Highway Patrol’s oversight of increased freeway service
36patrols identified in paragraph (1) of subdivision (a), if regional
37and local entities have proposed increased service, by a date
38specified in the program guidelines.
