An act to amend Sections 11343.5 and 26803.5 of the Government Code, relating to regulations.

Existing law requires the State Printing Office to file one copy of the published copies of the California Code of Regulations withbegin delete toend delete the county clerk in each county, to be made available for public inspection. Existing law authorizes the county clerk to delegate, to the paid county law librarian or the librarian in charge of the county law library, the duty of accepting and making the regulations available, if certain conditions are met.

This bill would instead require the State Printing Office to file the latest published copies of the California Code of Regulations with the librarian in charge of the countybegin delete library,end deletebegin insert library or county law library,end insert to be made available for public inspection, and would make conforming changes.

Because this bill would impose new duties on local officials, it would impose a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

SECTION 1.  

Section 11343.5 of the Government Code is

Within 10 days from the receipt of printed copies of
4the California Code of Regulations or of the California Code of
5Regulations Supplement from the State Printing Office, the office
6shall file one copy of the particular issue of the code or supplement
7with the librarian in charge of the county librarybegin insert or county law
8libraryend insert
in each county.

SEC. 2.  

Section 26803.5 of the Government Code is amended
10to read:

26803.5.  

Each regulation and order of repeal of a regulation
12filed withbegin delete aend deletebegin insert theend insert librarian in charge of a county librarybegin insert or county
13law library end insert
pursuant to Article 2 (commencing with Section
1411380) of Chapter 4.5, Part 1, Division 3, Title 2, of this code shall
15be retained in an active file, available for public inspection, until
16receipt by the librarian in charge of the county librarybegin insert or county
17law libraryend insert
of the next California Administrative Register or
18supplement to the California Administrative Code in which such
19regulation, order of repeal or notice thereof, is published.

20The librarian in charge of the county librarybegin insert or county law libraryend insert
21 shall at all times keep a complete current set of the California
22Administrative Code, and the California Administrative Register
23available for public inspection.

SEC. 3.  

If the Commission on State Mandates determines that
25this act contains costs mandated by the state, reimbursement to
26local agencies and school districts for those costs shall be made
27pursuant to Part 7 (commencing with Section 17500) of Division
284 of Title 2 of the Government Code.
