An act to amend Section 83 of the Labor Code, relating to employment.

AB 2046, as introduced, Harper. Division of Labor Standards Enforcement.

Existing law creates the Division of Labor Standards Enforcement, as the successor to the Division of Industrial Welfare, within the Department of Industrial Relations, and sets forth its powers and duties over labor standards enforcement.

This bill would make a technical, nonsubstantive change to these provisions.

The people of the State of California do enact as follows:

SECTION 1.  

Section 83 of the Labor Code is amended to read:

83.  

(a) The Division of Labor Standards Enforcement succeeds
3to, and is vested with, all of the powers, duties, purposes,
4responsibilities, and jurisdiction of the Division of Industrial
5Welfare, which is hereby abolished.

6(b) All powers, duties, purposes, and responsibilities of the
7Chief, Division of Industrial Welfare are hereby transferred to the
8Chief of the Division of Labor Standards Enforcement.

P2    1(c) Any regulation or other action made, prescribed, issued,
2granted, or performed by the abolished Division of Industrial
3Welfare in the administration, performance, or implementation of
4a function transferred pursuant to subdivision (a) of this section
5shall remain in effect and shall be deemed to be a regulation or
6action of the Division of Labor Standards Enforcement unless and
7until repealed, modified, or rescinded bybegin delete suchend deletebegin insert theend insert division.

8(d) Whenever any reference is made in any law to the abolished
9Division of Industrial Welfare it shall be deemed to be a reference
10to, and to mean, the Division of Labor Standards Enforcement.
