An act to add Section 66025.4 to the Education Code, relating to public postsecondary education.

AB 2064, as introduced, Travis Allen. Public postsecondary education: tuition and mandatory systemwide fees.

Existing law establishes the California State University, under the administration of the Trustees of the California State University, and the University of California, under the administration of the Regents of the University of California, as 2 of the segments of public postsecondary education in this state. Existing law authorizes these segments to charge students tuition and mandatory systemwide fees, among other charges, for attendance at these institutions. The existing Donahoe Higher Education Act specifies that none of its provisions applies to the University of California except to the extent that the regents, by appropriate resolution, make that provision applicable.

This bill would add to the Donahoe Higher Education Act a provision requiring the trustees, and the regents if they act by appropriate resolution as referenced above, to determine the amounts of undergraduate tuition and mandatory systemwide fees for each incoming first-year class. The bill would prohibit the tuition and mandatory systemwide fees set for an incoming first-year class under the bill from being increased for that class, except as specified. The bill would provide that the exceptions do not apply to a student during the time the student is taking a leave of absence to serve in the military.

SECTION 1.  

Section 66025.4 is added to the Education Code,

66025.4.  

(a) Subject to Section 67400, the Trustees of the
4California State University and the Regents of the University of
5California shall determine the amounts of undergraduate tuition
6and mandatory systemwide fees for each incoming first-year class.
7The tuition and mandatory systemwide fees set for an incoming
8first-year class under this section shall not be increased for that
9class, except under either or both of the following scenarios:

10(1) At least four academic years have passed.

11(2) To reflect the percentage change, if any, in the Consumer
12Price Index calculated by the Bureau of Labor Statistics of the
13United States Department of Labor during the previous academic
14year.

15(b) The exceptions in paragraphs (1) and (2) of subdivision (a)
16do not apply to a student during the time the student is taking a
17leave of absence to serve in the military.
