Existing law requires a school district to provide access to free, fresh drinking water during meal times in school food service areas by July 1, 2011, unless the governing board of a school district adopts a resolution stating that it is unable to comply with this requirement and demonstrating the reasons why it is unable to comply due to fiscal constraints or health and safety concerns.

This bill would require the State Department of Education to establish, by regulation, a grant program for local educational agencies to install new water filling stations on school campuses or to replace existing water fountains on school campuses with new water filling stations. The bill would provide that its provisions shall not be implemented unless funding is provided for its purposes in the annual Budget Act or another statute.

(a) The department shall establish, by regulation, a
4grant program for local educational agencies to install new water
5filler stations on school campuses.

6(b) Grant recipients may use grant funds only to install new
7water filling stations on school campuses or to replace existing
8water fountains on school campuses with new water filling stations.

9(c) For purposes of this section, “local educational agencies”
10include school districts, charter schools, and county offices of
11education.

12(d) This section shall not be implemented unless funding is
13provided for its purposes in the annual Budget Act or another
14 statute.

SECTION 1.  

Section 44260 of the Education Code is amended
16to read:

44260.  

The minimum requirements for the three-year
18preliminary designated subjects career technical education teaching
19credential shall be all of the following:

20(a) Three years or the equivalent of adequate, successful, and
21recent experience in, or experience and education in, the subject
22named on the credential.

23(b) Possession of a high school diploma or the passage of an
24equivalency examination as designated by the commission.

25(c) Satisfaction of the requirements for teacher. fitness, as
26specified in Sections 44339, 44340, and 44341.

27(d) Notwithstanding subdivision (a), the holder of a credential
28described in this section shall satisfy the minimum experience
29requirements established by the local educational agency for each
30course he or she is assigned to teach.
