Existing law authorizes the Director of General Services, with the approval of the Adjutant General, to lease and sell real property held for armory purposes, subject to legislative approval. Existing law establishes the Armory Fund and requires that the net proceeds from the sale or lease of armories be deposited into the fund, for use, upon appropriation by the Legislature, for specified purposes related to armories.

This bill would require the Director of General Services, with approval of the Adjutant General, to grant the City of Santa Barbara or the Santa Barbara Unified School District an option to purchase the Santa Barbara Armory, as specified. The bill would additionally require the director, upon expiration of the option, to offer the armory for sale by general bid.

This bill would make legislative findings and declarations as to the necessity of a special statute for the City of Santa Barbara.

Existing law requires the Military Department to submit an annual report to the Legislature on the status of all California armories. Existing law requires this report to include, among other things, information on the utilization of the facilities of the armory for military missions, emergency response, and community and social services.

This bill would require the report to additionally include information on the utilization of the armory for educational services.

(a) Notwithstanding Section 2 of Chapter 355 of
2the Statutes of 2015, the Director of General Services, with
3approval of the Adjutant General, shall grant to the City of Santa
4Barbara or the Santa Barbara Unified School District an option
5to purchase the Santa Barbara Armory. The option shall expire
6on July 1, 2017. The purchase agreement may consider the
7contributory value of all capital improvements made to the Santa
8Barbara Armory by the City of Santa Barbara less the value of
9improvements made in lieu of rents during the term of the use of
10the Santa Barbara Armory by the City of Santa Barbara, and any
11state costs incurred in the sale of the Santa Barbara Armory to
12the City of Santa Barbara or the Santa Barbara Unified School
13District.

14(b) If the option granted pursuant to subdivision (a) expires,
15the Santa Barbara Armory shall be offered for sale by general bid.
16Any purchase agreement made pursuant to this paragraph shall
17include terms and conditions determined by the Director of General
18Services to be in the best interest of the state based on the fair
19market value of the armory as determined by an appraisal
20undertaken and approved by the Department of General Services.

21(c) (1) The sale of the Santa Barbara Armory shall be conducted
22pursuant to Section 435 of the Military and Veterans Code.

23(2) For the purposes of this act, the Santa Barbara Armory
24means the approximately 3.03 acres of real property with
25improvements made thereon, located at 700 E. Canon Perdido
26Street, Santa Barbara, California.

The Legislature finds and declares that a special law
28is necessary and that a general law cannot be made applicable
29within the meaning of Section 16 of Article IV of the California
30Constitution because of the current use of the Santa Barbara

2location of the armory in the city of Santa Barbara.

SECTION 1.  

Section 439.1 of the Military and Veterans Code
4 is amended to read:

439.1.  

(a) The Legislature hereby finds and declares that the
6Military Department is unable to perform its security, emergency
7response, and social and community missions due to deficiencies
8in the physical condition and suitability of some of its armories,
9and according to a 2006 Bureau of State Audit report, at least 87
10percent of the 109 armories in California are in need of
11improvement.

12(b) It is the intent of the Legislature to ensure that the Military
13Department has adequate facilities to perform its security,
14emergency response, and social and community missions.

15(c) The Military Department shall, on or before April 1, 2008,
16and each year thereafter, submit a report to the Legislature on the
17status of all California armories. For each armory, the report shall
18include:

19(1) The location of the armory.

20(2) The utilization of the facilities of the armory for military
21missions, emergency response, and community, educational, and
22social services.

23(3) The physical condition of the facilities of the armory for its
24current missions and uses.

25(4) Any identified improvement, renovation, and modernization
26projects for the facilities of the armory, and the total estimated
27costs to complete these projects.

28(5) The status of recent improvements undertaken at the facilities
29of the armory.

30(6) An 18-month projection of all work and improvements that
31will be completed on the facilities of the armory.

32(7) The projected workload and staffing necessary for the
33maintenance, repairs, improvements, and operating expenses of
34the facilities of the armory.
