Existing law authorizes the Director of General Services, with the approval of the Adjutant General, to lease and sell real property held for armory purposes, subject to legislative approval. Existing law establishes the Armory Fund and requires that the net proceeds from the sale or lease of armories be deposited into the fund, for use, upon appropriation by the Legislature, for specified purposes related to armories. Existing law authorizes the sale of specified armories.
This bill would require the Director of General Services, with approval of the Adjutant General, to grantbegin delete the City of Santa Barbara or the Santa Barbara Unified School Districtend deletebegin insert specified cities
and school districts, among others,end insert an option to purchasebegin delete the Santa Barbara Armory, as specified.end deletebegin insert specified armories located within their respective jurisdictions.end insert The bill would additionally require the director, upon expiration of thebegin delete option,end deletebegin insert options,end insert to offer thebegin delete armoryend deletebegin insert armoriesend insert for sale pursuant to existing law.
This bill would make legislative findings and
declarations as to the necessity of a special statute for thebegin delete City of Santa Barbara.end deletebegin insert entities being granted the options.end insert

The people of the State of California do enact as follows:
(a) begin insert(1)end insertbegin insert end insertbegin insert(A)end insertbegin insert end insert Notwithstanding Section 2 of
2Chapter 355 of the Statutes of 2015, the Director of General
3Services, with approval of the Adjutant General, shall grant to the
4City of Santa Barbara or the Santa Barbara Unified School District
5an option to purchase the Santa Barbara Armory. The option shall
6expire on July 1, 2017.begin delete Any purchase agreement pursuant to this
7paragraph shall include terms and conditions determined by the
8Director of General Services to be in the best interest of the state
9based on the fair market value of the armory, based on the zoning
10as it existed on March 1, 2016, as determined by an appraisal
11undertaken and approved by the Director of General Services.end delete

(B) For the purposes of this act, the Santa Barbara Armory
13means approximately 4.7 acres of real property (APN:
14031-041-001) with an approximately 27,000 square foot armory
15building and ancillary improvements made thereon, located at 700
16East Canon Perdido Street, Santa Barbara, California, known as
17the Santa Barbara Armory.

(2) (A) Notwithstanding Section 2 of Chapter 355 of the Statutes
19of 2015, the Director of General Services, with approval of the
20Adjutant General, shall grant to the City of Brawley or the Brawley
21Union High School District an option to purchase the Brawley
22Armory. The option shall expire on July 1, 2017.

(B) For the purposes of this act, the Brawley Armory means
24approximately 1.78 acres of real property with improvements made
25thereon, located at 650 North Second Street, Brawley, California,
26known as the Brawley Armory.

(3) (A) Notwithstanding Section 2 of Chapter 355 of the Statutes
28of 2015, the Director of General Services, with approval of the
29Adjutant General, shall grant to the City of Indio an option to
30purchase the Indio Armory. The option shall expire on July 1,
312017.

(B) For the purposes of this act, the Indio Armory means
2approximately 2.31 acres of real property with improvements
made
3thereon, located at 43143 North Jackson Street, Indio, California,
4known as the Indio Armory.

(4) (A) Notwithstanding Section 2 of Chapter 355 of the Statutes
6of 2015, the Director of General Services, with approval of the
7Adjutant General, shall grant to the City of Lynwood an option to
8purchase the Lynwood Armory. The option shall expire on July 1,
92017.

(B) For the purposes of this act, the Lynwood Armory means
11approximately 1.03 acres of real property with improvements made
12thereon, located at 11398 Bullis Road, Lynwood, California, known
13as the Lynwood Armory.

(5) (A) Notwithstanding Section 2 of Chapter 355 of the Statutes
15of 2015, the Director of General Services, with approval of the
16Adjutant General, shall grant to the City of Pomona an option to
17purchase the Pomona Park Armory. In the event that the City of
18Pomona does not act on that option, then the Director of General
19Services, with approval of the Adjutant General, shall grant to the
20County of Los Angeles an option to purchase the Pomona Park
21Armory. The option shall expire on July 1, 2017.

(B) For the purposes of this act, the Pomona Park Armory means
23approximately 0.635 acres of real property with improvements
24made thereon, located at 600 South Park Avenue, Pomona,
25California, known as the Pomona Park Armory.
26(b) Ifbegin delete the option granted pursuant to subdivision (a) expires, the begin insert
an option granted pursuant to subdivision
27Santa Barbara Armoryend delete
28(a) to purchase an armory expires, that armoryend insert shall be offered
29for sale
pursuant to Sections 1 and 2 of Chapter 355 of the Statutes
30of 2015.
31(c) (1) The sale of the Santa Barbara Armory shall be conducted
32pursuant to Section 435 of the Military and Veterans Code.
33(2) For the purposes of this act, the Santa Barbara Armory means
34the approximately 4.7 acres of real property (APN: 031-041-001)
35with an approximately 27,000 square foot armory building and
36ancillary improvements made thereon, located at 700 E. Canon
37Perdido Street, Santa Barbara, California.

(c) The sale of each armory pursuant to subdivision (a) shall
39be conducted pursuant to Section 435 of the Military and Veterans
40Code.

(d) Any purchase agreement pursuant to subdivision (a) shall
2include terms and conditions determined by the Director of General
3Services to be in the best interest of the state based on the fair
4market value of the armory, based on the zoning as it existed on
5March 1, 2016, as determined by an appraisal undertaken and
6approved by the Director of General Services.
The Legislature finds and declares that a special law
8is necessary and that a general law cannot be made applicable
9within the meaning of Section 16 of Article IV of the California
