An act to amend Sections 44253.3, 44253.4, and 44274.2 of the Education Code, relating to teacher credentialing.

AB 2248, as introduced, Holden. Teacher credentialing: out-of-state trained teachers.

Existing law requires the Commission on Teacher Credentialing to issue a 5-year preliminary teaching credential to an out-of-state prepared teacher who meets specified requirements. Existing law requires the commission to issue a clear teaching credential to an out-of-state prepared applicant who satisfies specified requirements, including verifying 2 or more years of teaching experience.

This bill would require the commission to issue these teaching credentials within 30 days of receiving all required documentation.

Existing law requires the commission to issue authorizations for a teacher to provide specific services to limited-English-proficient pupils, if certain minimum requirements are met.

This bill would require the commission, within 30 days of receiving all required documentation, to issue these authorizations to a teacher who holds a valid teaching credential or is applying for a certain teaching credential as an out-of-state prepared teacher and is able to present a valid out-of-state credential or certificate that authorizes the equivalent level of instruction of English learners.

The people of the State of California do enact as follows:

SECTION 1.  

Section 44253.3 of the Education Code is
2amended to read:

44253.3.  

(a) The commission shall issue an authorization for
4a teacher to provide all of the following services to
5limited-English-proficient pupils:

6(1) Instruction for English language development in preschool,
7kindergarten, grades 1 to 12, inclusive, and classes organized
8primarily for adults, except when the requirement specified in
9paragraph (1) of subdivision (b) is satisfied by the possession of
10a children’s center instructional permit pursuant to Sections 8363
11and 44252.7, a children’s center supervision permit pursuant to
12Section 8363, or a designated subjects teaching credential in adult
13education pursuant to Section 44260.2. If the requirement specified
14in paragraph (1) of subdivision (b) is satisfied by the possession
15of a children’s center instructional permit, or a children’s center
16supervision permit, instruction for English language development
17is limited to the programs authorized by that permit. If the
18requirement specified in paragraph (1) of subdivision (b) is satisfied
19by the possession of a designated subjects teaching credential in
20adult education, instruction for English language development is
21limited to classes organized primarily for adults.

22(2) Specially designed content instruction delivered in English
23in the subjects and at the levels authorized by the teacher’s
24prerequisite credential or permit used to satisfy the requirement
25specified in paragraph (1) of subdivision (b).

26(b) The minimum requirements for the authorization, which
27may be completed at the same time as the initial preparation for
28the prerequisite credential or at a later date, shall include all of the
29following:

30(1) Possession of a valid California teaching credential, services
31credential, visiting faculty permit, children’s center instructional
32permit, or children’s center supervision permit which credential
33or permit authorizes the holder to provide instruction to pupils in
34preschool, kindergarten, any of grades 1 to 12, inclusive, or classes
35primarily organized for adults, except for any of the following:

36(A) Emergency credentials or permits.

37(B) Exchange credentials as specified in Section 44333.

38(C) District intern credentials as specified in Section 44325.

P3    1(D) Sojourn certificated employee credentials as specified in
2Section 44856.

3(E) Teacher education internship credentials as specified in
4Article 3 (commencing with Section 44450) of Chapter 3.

5(2) Passage of one or more examinations, or by completing an
6approved program that consists of coursework or a combination
7of coursework and examinations, that the commission determines
8is necessary for demonstrating the knowledge and skills required
9for effective delivery of the services included in the authorization.

10(3) Completion of at least six semester units, or nine quarter
11units, of coursework in a second language at a regionally accredited
12institution of postsecondary education. The commission shall
13establish minimum standards for scholarship in the required
14coursework. The commission also shall establish alternative ways
15in which the requirement can be satisfied by language-learning
16experience that creates an awareness of the challenges of
17 second-language acquisition and development.

SEC. 2.  

Section 44253.4 of the Education Code is amended to
27read:

44253.4.  

(a) The commission shall issue an authorization for
29a teacher to provide all of the following services to
30limited-English-proficient pupils:

31(1) Instruction for English language development in preschool,
32kindergarten, grades 1 to 12, inclusive, and classes organized
33primarily for adults, except when the requirement specified in
34paragraph (1) of subdivision (b) is satisfied by the possession of
35a children’s center instructional permit pursuant to Sections 8363
36and 44252.7, a children’s center supervision permit pursuant to
37Section 8363, or a designated subjects teaching credential in adult
38education pursuant to Section 44260.2. If the requirement specified
39in paragraph (1) of subdivision (b) is satisfied by the possession
40of a children’s center instructional permit, or a children’s center
P5    1supervision permit, then instruction for English language
2development shall be limited to the programs authorized by that
3permit. If the requirement specified in paragraph (1) of subdivision
4(b) is satisfied by the possession of a designated subjects teaching
5credential in adult education, then instruction for English language
6development shall be limited to classes organized primarily for
7adults.

8(2) Specially designed content instruction delivered in English
9in the subjects and at the levels authorized by the teacher’s

13in the subjects and at the levels authorized by the teacher’s

15specified in paragraph (1) of subdivision (b).

16(4) Instruction for primary language development in preschool,
17kindergarten, grades 1 to 12, inclusive, and classes organized
18primarily for adults, except when the requirement specified in
19paragraph (1) of subdivision (b) is satisfied by the possession of
20a children’s center instructional permit, a children’s center
21supervision permit, or a designated subjects teaching credential in
22adult education. If the requirement specified in paragraph (1) of
23subdivision (b) is satisfied by the possession of a children’s center
24instructional permit or a children’s center supervision permit, then
25instruction for primary language development is limited to the
26programs authorized by that permit. If the requirement specified
27in paragraph (1) of subdivision (b) is satisfied by the possession
28of a designated subjects teaching credential in adult education,
29then instruction for primary language development is limited to
30classes organized primarily for adults.

31(b) The minimum requirements for the authorization, which
32may be completed at the same time as the initial preparation for
33the prerequisite credential or at a later date, shall include both of
34the following:

35(1) Possession of a valid California teaching credential, services
36credential, visiting faculty permit, children’s center instructional
37permit, or children’s center supervision permit which credential
38or permit authorizes the holder to provide instruction to pupils in
39preschool, kindergarten, any of grades 1 to 12, inclusive, or classes
40primarily organized for adults, except for the following:

2(B) Exchange credentials as specified in Section 44333.

3(C) District intern credentials as specified in Section 44325.

4(D) Sojourn certificated employee credentials as specified in
5Section 44856.

8(2) Passage of one or more examinations, or by completing an
9approved program that consists of coursework or a combination
10of coursework and examinations, that the commission determines
11is necessary for demonstrating the knowledge, skills, and language
12proficiency required for effective delivery of the services included
13in the authorization.

14(c) To earn the authorization, teachers who hold the
15authorization described in Section 44253.3, or in Article 3.5
16(commencing with Section 44475) of Chapter 3, as that section
17and that article existed on December 31, 1992, shall not be required
18to pass examinations that primarily assess the skills and knowledge
19necessary for effective delivery of the services included in the
20authorizations they possess.

21(d) The authorization shall remain valid as long as the
22prerequisite credential or permit specified in paragraph (1) of
23subdivision (b) remains valid.

24(e) The commission initially shall issue authorizations for
25languages spoken by the largest numbers of
26limited-English-proficient pupils for which there are reasonable
27numbers of teachers or potential teachers who speak those
28languages. The commission shall explore alternative ways to make
29authorizations available for other languages.

30(f) The commission shall issue, within 30 days of receiving an
31application, a fee, and all documentation required, authorization
32under this section to a teacher who possesses a credential or permit
33described in paragraph (1) of subdivision (b) or is applying for a
34teaching credential pursuant to Section 44274.2, and is able to
35present a valid out-of-state credential or certificate that authorizes
36the equivalent level of instruction of English learners.

SEC. 3.  

Section 44274.2 of the Education Code is amended to
38read:

44274.2.  

(a) Notwithstanding any provision of this chapter,

2teaching credential authorizing instruction in a self-contained
3classroom, a five-year preliminary single subject teaching
4credential authorizing instruction in departmentalized classes, or
5a five-year preliminary education specialist credential authorizing
6instruction of special education pupils to an out-of-state prepared
7teacher who meets all of the following requirements:

8(1) Possesses a baccalaureate degree from a regionally accredited
9institution of higher education.

10(2) Has completed a teacher preparation program at a regionally
11accredited institution of higher education, or a state-approved
12teacher preparation program offered by a local educational agency.

13(3) Meets the subject matter knowledge requirements for the
14credential. If the subject area listed on the out-of-state credential
15does not correspond to a California subject area, as specified in
16Sections 44257 and 44282, the commission may require the
17applicant to meet California subject matter requirements before
18issuing a clear credential.

19(4) Has earned a valid corresponding elementary, secondary,
20or special education teaching credential based upon the out-of-state
21teacher preparation program. For the education specialist credential,
22the commission shall determine the area of concentration based
23on the special education program completed out of state.

24(5) Has successfully completed a criminal background check
25conducted under Sections 44339, 44340, and 44341 for
26credentialing purposes.

27(b) The holder of a credential issued pursuant to this section
28shall meet the state basic skills proficiency requirement set forth
29in Section 44252 within one year of the date the credential is issued
30or the credential shall become invalid.

a clear multiple subject, single subject,
33or education specialist teaching credential to an applicant who
34satisfies the requirements of subdivision (a), provides verification
35of two or more years of teaching experience, including, but not
36limited to, two satisfactory performance evaluations, and
37documents, in a manner prescribed by the commission, that he or
38she fulfills each of the following requirements:

39(1) The applicant has completed 150 clock hours of activities
40that contribute to his or her competence, performance, and
P8    1effectiveness in the education profession, and that assist the
2applicant in meeting or exceeding standards for professional
3preparation established by the commission, or the applicant has
4earned a master’s degree or higher in a field related to the
5credential, or the equivalent semester units, from a regionally
6accredited institution of higher education.

7(2) The applicant has met the state requirements for teaching
8English learners including, but not limited to, the requirements in
9Section 44253.3.

10(d) For applicants who do not meet the experience requirement
11described in subdivision (c), the commission shall issue a clear
12multiple subject, single subject, or education specialist teaching
13credential upon verification of the following requirements:

14(1) The commission has issued to the applicant a preliminary
15five-year teaching credential pursuant to subdivision (a). However,
16an out-of-state prepared applicant in both special education and
17general education, who has earned a clear California education
18specialist credential, shall be granted a clear multiple subject or
19clear single subject teaching credential without first holding a
20preliminary multiple subject or single subject teaching credential,
21unless the commission determines that the applicant does not meet
22the other requirements of this subdivision.

23(2) The applicant has completed a beginning teacher induction
24program pursuant to paragraph (2) of subdivision (c) of Section
2544259.

26(3) The applicant has met the requirements for teaching English
27learners, including, but not limited to, the requirements in Section
2844253.3.

29(4) Before issuing an education specialist credential under this
30subdivision, the commission shall verify completion of a program
31for the Professional Level II credential accredited by the
32commission.
