Existing law establishes the California State University, under the administration of the Trustees of the California State University, and the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as 2 of the 3 segments of public postsecondary education in this state. Existing law establishes community college districts throughout the state and authorizes them to provide instruction to students at community college campuses.

This bill would establish the California Health Care Coveragebegin delete Enrollment Assistanceend delete Act ofbegin delete 2016 to provide uninsured students of the California State University and the California Community Colleges withend deletebegin insert 2016, which would require the California State University and the California Community Colleges to provide their studentsend insert information about health care coverage optionsbegin delete and enrollment assistanceend delete
commencing with the 2017-18 academic year. The actbegin delete would, among other things,end deletebegin insert wouldend insert authorize each campus of the California State University and the California Community Colleges tobegin delete developend deletebegin insert
meet this requirement by developingend insert an informational item orbegin delete amendend deletebegin insert amendingend insert an existing enrollmentbegin delete form,end deletebegin insert formend insert or Internet Web site to providebegin delete uninsuredend delete students information about health care coverage options, as specified. its enrollment forms explaining basic information about affordable health care coverage options for students.begin insert The bill would repeal these new provisions on January 1, 2021.end insert
By requiring community colleges to perform additional duties, this bill would impose a state-mandated local program.
Existing law requires a public school, for purposes of the 2015-16, 2016-17, and 2017-18 school years, to add an informational item to its enrollment forms, or amend an existing enrollment form, in order to provide the parent or legal guardian information about health care coverage options and enrollment assistance, as specified. Existing law authorizes a school to also include a factsheet with its enrollment forms. Existing law requires the State Department of Education to, among other things, develop a standardized template for the factsheet and the informational item or amendment and make those templates available on its Internet Web site on or before August 1, 2015. Existing law repeals these provisions on January 1, 2019.
This bill would make the repeal date for these provisions January 1,begin delete 2024,end deletebegin insert 2021,end insert and thereby extend these requirements until that date. By extending these duties on local school districts, the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

The people of the State of California do enact as follows:
Section 49452.9 of the Education Code is
2amended to read:
(a) Commencing with the 2015-16 school year, and
4each school year thereafter, a public school, including a charter
5school, shall add an informational item to its enrollment forms, or
6amend an existing enrollment form, in order to provide the parent
7or legal guardian information about health care coverage options
8and enrollment assistance.
9(b) To satisfy the requirements of subdivision (a), a school may
10do either of the following:
11(1) Use a template developed pursuant to subdivision (d).
12(2) Develop an informational item or amend an existing
13enrollment form to provide
information about health care coverage
14options and enrollment assistance.
15(c) A school may include a factsheet with its enrollment forms
16explaining basic information about affordable health care coverage
17options for children and families.
18(d) (1) The department shall develop a standardized template
19for both of the following:
20(A) The informational item or amendment required by
21subdivision (a).
22(B) The factsheet described in subdivision (c).
23(2) The department shall make any templates developed pursuant
24to this subdivision available on its Internet Web site on or before
25August
1, 2015, and shall, upon request, provide written copies of
26the template to a school district.
27(e) A school district shall not discriminate against a pupil who
28does not have health care coverage or use any information relating
29to a pupil’s health care coverage or interest in learning about health
30care coverage in any manner that would bring harm to the pupil
31or the pupil’s family.
32(f) This section shall remain in effect only until January 1,begin delete 2024,end delete
33begin insert 2021,end insert and as of that date is repealed, unless a later enacted statute,

The California Health Care Coverage Enrollment
14Assistance Act of 2016 is hereby established to provide uninsured
15students of the California State University and the California
16Community Colleges with information about health care coverage
17options and enrollment assistance.
(a) Commencing with the 2017-18 academic year,
19each campus of the California State University and the California
20Community Colleges shall identify its uninsured students and offer
21these students contact information for local entities to provide
22health care enrollment assistance.
23(b) Commencing

25each campus of the California State University and the California
26Community Colleges shall offerbegin delete uninsured studentsend deletebegin insert every studentend insert
27 information about health care coverage options.
28(c) To satisfy the requirements of subdivision (a), the campus
29may do any of the following:
30(1) Add health insurance screening questions and contact
31information for local health care enrollment assistance entities to
32its enrollment forms.
33(2) Develop a screening method to identify uninsured students
34and offer these students contact information for local health care
35enrollment entities.
36(3) Partner with local organizations to ensure students who are
37identified as uninsured by the campus receive health care
38enrollment assistance.
