Existing law authorizes the Department of Transportation to contract with Amtrak for intercity rail passenger services and provides funding for these services from the Public Transportation Account.
This bill would require the department to develop a program for the reasonable mitigation of noise and vibration levels in residential neighborhoods along railroad lines where the department contracts for state-funded intercity rail passenger service. The bill would require the department to determine what constitutes a reasonable level of mitigation. The bill would provide that funding for the mitigation program shall be made available from funds appropriated by the Legislature for this purpose.

Section 14035.6 is added to the Government
2Code, to read:
The department shall develop a program for the
4reasonable mitigation of noise and vibration levels in residential
P2 1neighborhoods along railroad lines where the department contracts
2for state-funded intercity rail passenger service pursuant to Section
314035. The department shall determine what constitutes a
4reasonable level of mitigation. Funding for the mitigation program
5shall be made available from funds appropriated by the Legislature
6for this purpose.
