Existing law establishes the California Beginning Teacher Support and Assessment System, to be administered jointly by the Commission on Teacher Credentialing and the Superintendent of Public Instruction for specified purposes, including providing an effective transition into the teaching career for first-year and 2nd-year teachers in California.

Existing law requires the Superintendent, each fiscal year, to adjust the allocation made to a school district or consortium of school districts for each beginning teacher participating in a local teacher induction program pursuant to the California Beginning Teacher Support and Assessment System by the inflation factor set forth in a specified statute.

Existing law also required the Superintendent and the commission, by July 1, 2008, to review and revise the Standards of Quality and Effectiveness for Professional Teacher Induction Programs of March 2002.

The people of the State of California do enact as follows:

SECTION 1.  

The Legislature finds and declares all of the
2following:

3(a) According to the Commission on Teacher Credentialing, the
4number ofbegin delete pupilsend deletebegin insert studentsend insert enrolled in teacher preparation programs
5declined by more than 50 percent between 2008 and 2013.

6(b) At the same time that enrollment in teacher preparation
7programs is declining, more than 20 percent of California’s teachers
8have more than 20 years of experience, meaning they are at or near
9retirement age and will need to be replaced.

10(c) Among new teachers, 40 percent leave the profession within
11the first five years, adding to the teacher shortage and reducing
12the benefits of the state’s investment in teacher preparation.

P3    1(d) The California Beginning Teacher Support and Assessment
2System (Article 4.5 (commencing with Section 44279.1) of Chapter
32 of Part 25 of Division 3 of Title 2 of the Education Code), which
4was established in 1992, has been shown to substantially increase
5new teacher retention to nearly 90 percent. In addition, the
6California Beginning Teacher Support and Assessment System
7has been shown to improve teacher effectiveness and pupil
8outcomes.

9(e) There is a clear state interest in continuing the California
10Beginning Teacher Support and Assessment System as a proven
11means of effectively addressing the teacher shortage and improving
12teacher effectiveness and pupil outcomes.

13(f) With the enactment of the local control funding formula,
14ongoing funding targeted to the California Beginning Teacher
15Support and Assessment System was eliminated.

16(g) While the local control funding formula is an effective
17system for targeting spending to programs whose benefits accrue
18to local educational agencies and their pupils, it is not an effective
19system for the support of programs whose benefits primarily are
20external to local educational agencies and are more statewide than
21local.

22(h) The California Beginning Teacher Support and Assessment
23System serves a compelling state interest and should be funded
24each year in the annual Budget Act.

(a) The Superintendent and the commission shall
28jointly administer the California Beginning Teacher Support and

30administering this section, the Superintendent and the commission
31shall provide or contract for the provision of all of the following:

32(1) Establishing requirements for reviewing and approving
33teacher induction programs.

34(2) Developing and administering a system for ensuring teacher
35induction program quality and effectiveness. For purposes of this
36section, “program effectiveness” means producing excellent
37program outcomes in relation to the purposes defined in subdivision
38(b) of Section 44279.1. For purposes of this section, “program
39quality” means excellence with respect to program factors,
40including, but not limited to, all of the following:

2(B) Design resources.

3(C) Management, evaluation, and improvement of the program.

4(D) School context and working conditions.

5(E) Support and assessment services to each beginning teacher.

8and program consultants, as defined pursuant to Section 44279.7.

23commission and making changes to those documents, as necessary.

24(b) As part of the California Beginning Teacher Support and
25 Assessment System, the commission and the Superintendent shall
26establish requirements for local teacher induction programs.

27(c) A school district or consortium of school districts may apply
28to the Superintendent for funding to establish a local teacher
29induction program pursuant to this section. From amounts
30appropriated for purposes of this section, the Superintendent shall
31allocate three thousand dollars ($3,000) for each beginning teacher
32participating in the program. That amount shall be adjusted each

35funding, a school district or consortium of school districts shall,
36at a minimum, meet all of the following requirements:

37(1) Develop, implement, and evaluate teacher induction
38programs that meet the Quality and Effectiveness for Beginning
39Teacher Induction Program Standards adopted by the commission.

P5    1(2) Support beginning teachers in meeting the competencies
2described in the California Standards for the Teaching Profession
3adopted by the commission.

4(3) Meet criteria for the cost-effective delivery of program
5services.

6(4) From amounts received from local, state, or resources
7available for purposes of teacher induction programs, contribute
8not less than two thousand dollars ($2,000) for the costs of each
9beginning teacher served in the induction program.

10(d) Teachers who have received their preliminary credential in
11a district intern program pursuant to Article 7.5 (commencing with
12Section 44325) or an intern program pursuant to Article 3
13(commencing with Section 44450) of Chapter 3 and who are
14participating in an induction program pursuant to this section are
15not eligible for funding pursuant to Article 11 (commencing with
16Section 44380) of Chapter 2.

(e) In consultation with the Superintendent, the commission
18shall revise the formative assessment system for beginning
19teachers, as necessary to ensure that related tasks and activities
20are aligned to the current standards.

(f) The Superintendent and the commission shall identify
22effective practices and techniques and provide for the dissemination
23of these to local induction program providers.

(g) The commission shall review induction programs as
25necessary to determine whether local teacher induction programs
26are meeting current standards of quality and effectiveness and to
27ensure greater program quality and consistency.

(h) The Superintendent and the commission shall ensure that
29teacher credential candidates are notified of the opportunity to
30choose an early completion option pursuant to Section 44468.

(a) By December 1, 2007, the Superintendent and
33the commission shall report to the Legislature and the Governor
34on the current state of the Beginning Teacher Support and
35Assessment System. The report shall review the articulation of
36teacher preparation programs and teacher induction programs to
37eliminate duplicative requirements and, at a minimum, do all of
38the following:

39(1) Recommend revisions to laws, regulations, or policies to
40eliminate duplicative requirements between teacher preparation
P6    1and teacher induction programs, with particular attention paid to
2eliminating duplication between induction requirements and
3requirements for completion of state-approved alternative
4certification programs.

5(2) Recommend revisions to the system to ensure that teacher
6credential candidates achieve teaching competence and programs
7use best practices to transition candidates from teacher preparation
8programs to induction programs.

9(3) Recommend ways to ensure that beginning teachers receive
10direct assistance from experienced teachers who are familiar with
11the grade span, subject matter, and teaching and classroom
12management techniques appropriate to the teaching assignment of
13each beginning teacher.

14(b) By July 1, 2008, the Superintendent and the commission
15shall review and revise, as necessary, the Standards of Quality and
16Effectiveness for Professional Teacher Induction Programs of
17March 2002 to ensure that these standards address the application
18of knowledge and skills previously acquired in a preliminary
19credential program and to remove any requirements or activities
20that require candidates to duplicate the acquisition of knowledge
21through coursework. This review shall include, but need not be
22limited to, all of the following:

23(1) A review of formative assessment systems in use to ensure
24that the systems are appropriately flexible and may be adapted to
25reflect progress of individual candidates.

26(2) A review of professional development provided to induction
27participants to ensure that it is not duplicative of coursework
28completed during teacher preparation.

29(3) A review of new teacher support to ensure that the focus is
30on application and enhancement of skills and knowledge acquired
31in a preliminary credential program.

32(4) Recommendations for program monitoring with respect to
33this subdivision.

34(c) In consultation with the Superintendent, the commission
35shall revise the formative assessment system for beginning
36teachers, as necessary to ensure that related tasks and activities
37are aligned to the revised standards.

38(d) The Superintendent and the commission shall identify
39effective practices and techniques and provide for the dissemination
40of these to local induction program providers.

P7    1(e) Immediately following the adoption of revised standards
2pursuant to subdivision (b), the commission shall review induction
3programs to determine whether local teacher induction programs
4are meeting standards of quality and effectiveness adopted pursuant
5to subdivision (b) and to assure greater program quality and
6consistency. The commission shall schedule regular reviews
7following the initial review of programs pursuant to this
8subdivision.

9(f) The Superintendent and the commission shall ensure that
10teacher credential candidates are notified of the opportunity to
11choose an early completion option pursuant to Section 44468.

12(g) It is the intent of the Legislature that funds appropriated in
13Provision 44 of Item 6110-001-0890 of Section 2.00 of the Budget
14Act of 2006 (Chapter 47 of the Statutes of 2006) be made available
15for reviews and preparation of the reports required pursuant to
16subdivisions (a) and (b), and that the implementation of
17recommendations proceed immediately following the adoption of
18those reviews and reports.

(a) It is the intent of the Legislature that the executive

25process for verifying attainment of the performance standards,
26which shall be based on the results of the evaluation study required
27by Section 44279.2, as that section read on December 31, 1992.

28(b) It is the intent of the Legislature that the commission shall
29adopt and promulgate standards and requirements for earning the
30professional teaching credential pursuant to paragraph (2) of
31subdivision (a) of Section 44225 in accordance with Chapter 3.5
32(commencing with Section 11340) of Division 3 of Title 2 of the
33Government Code. The proposed regulations shall be developed
34jointly with thebegin delete Superintendent of Public Instruction, and shall be
35drafted in consultation with the panel established pursuant to
36subdivision (b) of Section 44259.2.end delete

39paragraph (2) of subdivision (a) of Section 44225 be operative
40within six months of the commission’s adoption of standards and
P8    1requirements for earning the professional credential. First priority
2shall be given to cost-effective requirements that maximize the
3use of existing state and local resources. The commission shall
4consider the use of credential fees and assessment fees to support
5the cost of implementing the requirements. In adopting professional
6teacher certification requirements pursuant to this subdivision, the
7commission shall include the criteria specified in subdivision (d)
8of Section 44225, and, in addition, shall include the following:

9(1) A rigorous program of candidate-centered assessment that
10relies upon individually evaluating the fitness of each individual
11candidate for a credential.

12(2) Rigorous assessments of each teaching candidate’s general
13knowledge and subject matter knowledge, that are designed to
14verify reading skills, writing ability, mathematical reasoning, and
15other elements of a liberal arts education.

16(3) Assessments of each teaching candidate’s instructionalbegin delete skillsend delete
17 and classroom management skills, including an assessment of each
18teaching candidate’s ability to work effectively withbegin delete studentsend deletebegin insert pupilsend insert
19 of both sexes and from a variety of ethnic, socioeconomic, cultural,
20academic, and linguistic backgrounds.

21(4) Alternatives for professionally supervising, supporting, and
22assisting beginning teachers for at least the critical first full
23teaching year.

24(5) Deregulation of the academic training of teachers by shifting
25the emphasis from granting credentials on the basis of program
26approval to granting credentials on the basis of comprehensive
27assessments of individual candidates.

30by the commission include passage of a standardized examination,
31the commission shall establish a procedure for approval by the
32commission of alternative examinations or assessments whose
33scope, contents, and level of difficulty are determined by the
34commission to be equivalent to the scope, contents, and level of
35difficulty of the standardized examination. In making these
36determinations, the commission may refer to and utilize, to the
37extent consistent with this section, accepted national and
38professional standards governing the use of tests and assessments,
39and governing the determination of equivalence between alternative
40tests and assessments. The commission shall recover the costs of
P9    1administering any standard examination that the commission adopts
2by collecting examination fees from examinees. An agency or
3organization that recommends an alternative examination that is
4approved by the commission shall pay the costs of developing and
5administering the alternative examination from any available source
6of funds, including examination fees, existing budget allocations,
7and amended budget allocations.

10checklists of competencies be adopted at the state level for the
11assessment of each beginning teacher’s classroom performance.

15commission shall continue to administer teacher certification
16requirements and regulations that were in effect on December 31,

(a) The superintendent and the commission shall
21award supplemental grants on a competitive basis to Beginning
22Teacher Support and Assessment System teacher induction
23programs established pursuant to Section 44279.2 that are identified
24as having expertise according to criteria established by the
25superintendent and the commission. The supplemental grants
26received pursuant to this section shall be expended to assist clusters
27of teacher induction programs operated by school districts or
28consortiums of school districts.

29(b) The superintendent and the commission shall designate each
30school district and consortium of school districts participating in
31the Beginning Teacher Support and Assessment System established
32pursuant to Section 44279.2 as belonging to a cluster according
33to the criteria established pursuant to this subdivision. For the
34purposes of this section “cluster” means a cluster of school districts
35or consortium of school districts established pursuant this section.
36The superintendent and the commission shall establish criteria for
37the formation of school districts or consortiums of school district
38teacher induction program clusters based upon, but not necessarily
39be limited to, all of the following:

40(1) Geographic proximity.

2(3) The number of beginning teachers served.

3(4) The similarity of teacher characteristics and pupil populations
4in each school district.

5(c) School districts and consortiums of school districts awarded
6supplemental grants pursuant to this section shall identify a teacher
7induction program consultant to assist the school district or
8consortiums of school districts forming a cluster. The
9superintendent and the commission shall identify the purpose and
10functions of each consultant. Those purposes and functions shall
11include, but not necessarily be limited to, all the following:

12(1) Assisting in designing, implementing, refining, and
13evaluating their teacher induction programs.

14(2) Assisting in building the capacity to provide professional
15development for all personnel involved in the implementation of
16teacher induction programs, including, but not limited to, beginning
17teachers, support providers, and administrators.

18(3) Disseminating information on teacher induction programs
19to all interested participants within the cluster and collaborating
20with other consultants statewide and with state administrative
21agency staff to ensure ongoing program improvement.

22(d) The superintendent and the commission shall ensure that
23each grant awarded pursuant to this section supports the salary and
24benefits and other related costs based on the prorated amount of
25time dedicated to this function for a consultant to assist each
26cluster.
