SUMMARY: Extends the sunset clause on certain provisions of the
Fish and Game Code, requires the Department of Parks &
Recreation (DPR) to provide donors with accountings of donation
expenditures, requires the DPR to make recommendations to
improve the state park planning process, and makes other
technical amendments.
The Senate amendments:
1)Extend the sunset date on existing law regarding invasive
quagga and zebra mussels from 2017 to 2020.
2)Repeal the sunset date on provisions of existing law
establishing procedural rules for administrative hearings on
listing petitions under the California Endangered Species Act

(CESA), allowing the provisions to continue in effect.
3)Require the DPR, with regard to donor agreements, to provide
donors with a written accounting of expenditures made from
donated funds, as specified.
4)Extend the date to January 1, 2018, by which the DPR, in
consultation with the State Park and Recreation Commission,
shall provide recommendations to the Legislature on ways to
improve the state park planning process.
5)Make other technical corrections.
EXISTING LAW:
1)Requires the DPR to prepare a general plan or revise an
existing general plan for a unit of the state park system
following classification of the unit by the State Park and
Recreation Commission, and prior to the development of new
facilities in any previously classified unit. Authorizes the
DPR to prepare a management plan that includes appropriate
environmental review and analysis, instead of a general plan,
for a park unit to which new development is necessary to
comply with public service delivery obligations, operational
or code compliance upgrades, or resource preservation
requirements compatible with the unit's classification.
2)Requires general plans for state park units to be prepared by
the DPR and reviewed and approved by the State Parks and
Recreation Commission. Requires a general plan for a state
park unit that is the subject of an operating agreement to
evaluate and define the manner in which the unit is proposed
to be operated. Requires the general plan to be reviewed by
the State Park and Recreation Commission to determine that the
unit will be operated in a manner that generally meets the
standards followed by the DPR in its operation of similar

units, that enhances public use, enjoyment, recreation and
education at the unit, and provide for satisfactory management
of park resources.
3)Prohibits the possession, importation, transportation,
transfer or release of dreissenid mussels in California, and
authorizes the DFW to conduct inspections and take other
related actions to prevent the spread of the invasive mussels.
These provisions sunset on January 1, 2017, unless extended.
4)Establishes procedural rules for administrative proceedings
under CESA. Some of these provisions sunset on January 1,
2017, unless extended.
FISCAL EFFECT: According to the Senate Appropriations
Committee, pursuant to Senate Rule 28.8, negligible if any state
costs.
COMMENTS: This is a committee bill that extends the sunset date
on several sections of the Fish and Game Code that will
otherwise sunset the end of this year. The sunset extensions
address two different areas of law: an existing state program
to prevent spread of invasive quagga and zebra mussels, and
administrative procedural provisions that apply to CESA. This
bill also clarifies the information to be included in cost
analyses required for state park revenue generation projects,
and requires the DPR, with regard to donor agreements, to
provide quarterly written accountings of expenditures to donors,
unless a different frequency of accounting is agreed to by the
parties to the agreement. The Senate amendments also make other
technical changes to update a section of the Public Resources
Code to conform to changes enacted last year regarding park
concession agreements.
Committee bills are often introduced to enact technical or
noncontroversial but needed amendments to statutes. This bill
would extend or repeal the sunset date in two different areas of

the Fish and Game Code. This bill also includes provisions
designed to facilitate improved management of state parks.
There is no known opposition.
