Existing law establishes the Department of Resources Recycling and Recovery to administer the California Integrated Waste Management Act of 1989, and authorizes the department to hold hearings and conduct investigations in any part of the state necessary to carry out its powers and duties.

(a) In the next regularly scheduled waste
4characterization study conducted by the department on or after
5January 1, 2017, the department shall include all of the following
6information:

(1) The amount of food service packaging, by material type,
8used in California and the disposition of the products, including
9the percentages recycled, composted, and disposed and an estimate
10of the percentage littered.

(2) The facilities located in the state that accept food service
12packaging for recycling or composting, the cities those facilities
13serve, and the infrastructure needed to increase the recycling rate
14to reach California’s statewide recycling goal of 75 percent and
15reduce
litter.

(3) The current and potential markets for recycled and
17composted food service packaging products.

(4) Barriers to the increased recycling and composting of food
19service packaging and steps that may be taken to remove those
20barriers.

(b) For purposes of this section, “food service packaging”
22means single-use packaging products used by food service
23providers for their customers for food that is prepared onsite.
(a) For purposes of this section, “food service
25packaging” means single-use packaging products used by food
26service providers for their customers for food that is prepared
27onsite.
28(b) On or before January 1, 2018, the Department of Resources
29Recycling and Recovery shall complete a study to establish
30baseline data relating to food service packaging.
P3 1(c) The study required pursuant to subdivision (b) shall contain
2all of the following information:
