An act to add Section 44050 to the Education Code, relating to school employees.

Existing law requires local educational agencies to provide certain documents to parents and post certain documents on an Internet Web page.

This bill would require a local educational agency, or a person, firm, association, partnership, or corporation offering or conducting private school instruction on the elementary or high school level, that maintains an employee code of conduct with pupils to provide a written copy of that document to the parent or guardian of each enrolled pupil at the beginning of each school year and to post it to a public page on eachbegin insert of itsend insert school’s Internet Web site, or, if a school within the local educational agency does not have its own Internet Web site, on the local educational agency’s Internet Web site. The bill would also provide that a local educational agency may satisfy the individual parent notification requirement by including a copy of the document with other specified notifications that are required at the beginning of the first semester or quarter of the regular school term.

SECTION 1.  

Section 44050 is added to the Education Code,

44050.  

(a) A local educational agency, or a person, firm,
4association, partnership, or corporation offering or conducting
5private school instruction on the elementary or high school level,
6that maintains an employee code of conduct with pupils shall
7provide a written copy of that document to the parent or guardian
8of each enrolled pupil at the beginning of each school year and
9shall post it on eachbegin insert of itsend insert school’s Internet Web site, or, if a school
10within the local educational agency does not have its own Internet
11Web site, on the local educational agency’s Internet Web site, in
12a manner that is accessible to the public without a password.

13(b) A local educational agency may satisfy the requirement to
14provide a written copy to the parent or guardian of each enrolled
15pupil by including the document in the notice required pursuant
16to Section 48980.

17(c) For purposes of this section, a local educational agency
18includes a school district, county office of education, or charter
19 school.

(d) This section shall not be construed to require a local
21educational agency, a school within a local educational agency,
22or a private school to create an Internet Web site if it does not
23have one.
