BILL ANALYSIS Ó AB 2659 Page 1 Date of Hearing: May 4, 2016 ASSEMBLY COMMITTEE ON EDUCATION Patrick O'Donnell, Chair AB 2659 (Committee on Education) - As Amended April 25, 2016 SUBJECT: Elementary and secondary education: omnibus revisions SUMMARY: Makes technical and non-controversial revisions to the Education Code. Specifically, this bill: 1)Repeals the following reports required of the California Department of Education (CDE): a) The number of site visits conducted of child development programs. (Section 1) b) Evaluation of the effectiveness of CDE's School Safety and Security Resources Unit. (Section 2) c) Summary of actions taken by the CDE to eliminate audit exceptions and comply with management improvement recommendations. (Section 38) d) The status of school districts that have received emergency apportionments. (Section 39) AB 2659 Page 2 e) Review of a county office of education's fiscal oversight of a school district requiring an emergency loan and state receivership. (Section 40) f) Summary of school average daily attendance and local property tax revenues used in principal apportionment calculations. (Section 42) g) Summary of school districts that have not adopted on-time budgets and steps being taken to address the delays. (Section 44) h) Evaluation of the California School Information Services' oversight of the California Longitudinal Pupil Achievement Data System (CALPADS) project. (Section 49) i) Summary of educational programs and workshops on genetic diseases and birth defects. (Section 50) j) Agreements between state agencies regarding special education services. (Section 57) aa) Compilation of student physical fitness test results. (Section 58) bb) Evaluation of the CALPADS project. (Section 59) cc) Update on implementation of the school standardized account code structure. (Section 60) AB 2659 Page 3 2)Requires the meetings of district and county parent advisory committees established to provide advice on the development of the local control and accountability plan to be open to the public and to comply with specified notice of meetings. Strikes obsolete code sections. (Section 3) 3)Changes "lapse" to "lapsation." (Section 4) 4)Corrects cross references and makes minor changes to the sections relating to school district reorganizations. (Sections 6-36) 5)Strikes "unexcused" absences to allow Saturday or Sunday classes to receive apportionment credit for makeup classes for any absences and not just unexcused absences. (Section 37) 6)Updates references to the federal Workforce Invest Act. (Sections 45, 47, 51, 52) 7)Corrects a federal code section reference to the United States military that was chaptered by AB 306 (Hadley), Chapter 771, Statutes of 2015. (Section 48) 8)Aligns cross references in sections pertaining to students with disabilities with changes in the California Code of Regulations. (Sections 53-56) 9)Corrects code citations and cross references (Sections 5, 41, 43, 46) AB 2659 Page 4 EXISTING LAW assigns various duties to state and local educational agencies and governs the operation of public schools. FISCAL EFFECT: Unknown COMMENTS: This bill is the annual K-12 education clean-up bill that makes various non-controversial revisions to the Education Code. By tradition, objection to any provision by the agency affected, the Department of Finance, or any of the four legislative caucuses prevents that provision from being included in this bill. The majority of the provisions in this bill were identified by the CDE and make technical corrections to the statute, such as correcting a section citation or striking obsolete language. This bill also repeals a number of reports required to be submitted by the CDE to the Legislature, some of which are active and some of which were never implemented due to lack of funds. The information generated by these reports can be obtained from the CDE without requiring the CDE to complete and submit reports on a regular basis.
