SUBJECT: Elementary and secondary education: omnibus
revisions

DIGEST: This bill, the education omnibus clean-up measure,
makes technical, non-controversial revisions to numerous
provisions of the Education Code.
ANALYSIS:
Each year, there is typically a K-12 education clean-up bill and
a higher education clean-up bill that make various
non-controversial revisions to the Education Code. A majority
of the provisions for the K-12 education clean-up bill are
identified by the State Department of Education and propose
technical corrections to existing law, such as deleting an

obsolete reporting requirement for a program.
This bill makes numerous revisions to the Education Code.
Specifically, this bill
1) Eliminates various reporting requirements and program
evaluations that are either outdated or the information can
be provided upon request:
a) The number of site visits conducted of child
development programs. (Section 1)
b) Evaluation of the effectiveness of California
Department of Education's (CDE's) School Safety and
Security Resources Unit. (Section 2)
c) Summary of actions taken by the CDE to eliminate audit
exceptions and comply with management improvement
recommendations. (Section 38)
d) The status of school districts that have received
emergency apportionments. (Section 39)
e) Review of a county office of education's fiscal
oversight of a school district requiring an emergency loan
and state receivership. (Section 40)
f) Summary of school average daily attendance and local
property tax revenues used in principal apportionment
calculations. (Section 42)
g) Summary of school districts that have not adopted
on-time budgets and steps being taken to address the
delays. (Section 44)
h) Evaluation of the California School Information
Services' oversight of the California Longitudinal Pupil
Achievement Data System (CALPADS) project. (Section 50)
i) Summary of educational programs and workshops on
genetic diseases and birth defects. (Section 51)
j) Agreements between state agencies regarding special

education services. (Section 58)
aa) Compilation of student physical fitness test results.
(Section 59)
bb) Evaluation of the CALPADS project. (Section 60)
cc) Update on implementation of the school standardized
account code structure. (Section 61)
2) Clarifies that the parent advisory committee established to
provide advice in the development of local control and
accountability plans subject to provisions in current law
related to open and public meetings. (Section 3)
3) Makes clarifying changes in numerous terms and phrases,
conforming state statutes to federal regulations and update
cross-references to statutes and to state regulations.

4) Corrects cross references and makes minor changes to the
sections relation to school districts and reorganization.

5) Updates federal workforce investment act references.
(Sections 46, 48, 52 and 53)
6) Corrects references to the United States Military Code
defining active duty military personnel. (Section 49)
7) Adds provisions regarding attendance alternative for
children of military personnel found in Education Code
Section 48300 and 48301 to EC Section 46600 relative
interdistrict attendance thereby fixing a drafting oversight.

8) Clarifies the definition of "lapse" to mean dissolve a
school district, as described and the term "lapsation," to
mean an action to lapse. Makes a conforming change. (Section
36)
9) Deletes "unexcused," absences to allow Saturday and Sunday

classes to received apportionment credit for makeup classes
for any absences rather than only for "unexcused," absences.

10)Removes obsolete references and makes other technical
changes to the education code.
Comments
1)Non-controversial amendments. This bill is the annual
education omnibus clean-up bill and proposes technical,
non-controversial amendments to existing law. By tradition,
if any affected agency, the Department of Finance, or any of
the four legislative caucuses objects to a provision in the
bill or one that is being considered, that particular
provision cannot be included.
