Existing law creates the Public Employment Relations Board and prescribes its powers, which include deciding contested matters relating to the recognition, certification, or decertification of public employee organizations. Under existing law, a decertification petition must be accompanied by proof that at least 30% of the employees in the established unit either no longer wish to be represented by the incumbent exclusive representative or wish to be represented by another employee organization.

The board shall complete and publish the results of
4a decertification election within 90 days after the board has
5determined the sufficiency of the proof of support for the
6decertification petition.
Section 3520.5 of the Government Code is
8amended to read:
(a) The state shall grant exclusive recognition to
10employee organizations designated or selected pursuant to rules
11established by the board for employees of the state or an
12appropriate unit thereof, subject to the right of an employee to
13represent himself or herself.
14(b) The board shall establish reasonable procedures for petitions
15and for holding elections and determining appropriate units
16pursuant to subdivision (a).
17(c) The board shall also establish procedures whereby
18recognition of employee organizations formally recognized as
19exclusive
representatives pursuant to a vote of the employees may
20be revoked by a majority vote of the employees only after a period
21of not less than 12 months following the date of such recognition.
