AB 2680, as amended, Bonilla. Parent, guardian, pupil, and family engagement support and services: plans.
Existing law states various legislative findings and declarations, including that it is essential to our democratic form of government that parents and guardians of schoolage children attending public schools and other citizens participate in improving public education institutions, that specifically involving parents and guardians of pupils in the education process is fundamental to a healthy system of public education, and that family and school collaborative efforts are most effective when they involve parents and guardians in a variety of roles at all grade levels, from preschool through high school.
This bill would, subject to one-time funding being provided for purposes of this act in the annual Budget Act, require local educational agencies, including county offices of education, charter schools, alternative education programs and
schools,begin insert andend insert state special schools,begin delete and state subsidized preschools and child development programs,end delete that elect to participate in family, parent, guardian, and pupil engagement support and services to develop, implement, and, once adopted, post to its Internet Web site, abegin delete plan that addresses at least one specified parent, guardian, pupil, and family engagement
element relating to active and meaningful participation and training.end deletebegin insert strategic plan, as provided.end insert If a local educational agency accepts funds appropriated in the annual Budget Act for purposes of those provisions, as a condition of receiving those funds, the school district, county office of education, or charter school would be required to develop and post to its Internet Web site an additional plan that aligns to the school district’s or county office of education’s local control and accountability plan or specified elements of the charter school’s petition that delineates how funds apportioned for purposes of this section, if they are apportioned, would be spent, as specified. If funds are appropriated in the annual Budget Act for these purposes, the bill would authorize a local educational agency to request funding from the Superintendent of Public Instruction and would require the local
educational agency to expend those funds between the 2016-17 fiscal year and the 2018-19 fiscal year, inclusive, and would require the funds to be intended to supplement, not supplant, funds used by the local educational agency for parent, guardian, pupil, and familybegin delete engagement.end deletebegin insert engagement and that the funds be allocated on the basis of an equal amount per average daily attendance among participating local educational agencies.end insert The bill would provide that the funds, if appropriated, would be applied toward the minimum funding requirements for school districts and community college districts imposed by Section 8 of Article XVI of the California Constitution.

Section 51103 is added to the Education Code,
2to read:
(a) (1) Subject to one-time funding being provided
4for these purposes in the annual Budget Act, local educational
5agencies, including county offices of education, charter schools,

7schools,begin delete and state subsidized preschools and child development that elect to participate in family, parent, guardian, and
8programs,end delete
9pupil engagement support and services funded pursuant to this
10section shall develop and implement abegin insert
strategicend insert plan that addresses
11begin delete at least one ofend deletebegin insert both ofend insert the following:
P3 1(A) Active and meaningful participation and training of parents,
2guardians, pupils, and families of children
served by the local
3educational agency in the development and updating of local
4control and accountability plans required pursuant to Article 4.5
5(commencing with Section 52060) of Chapter 6.1.
6(B) Active and meaningful participation and training at the
7schoolsite or program site and school district or county office of
8education level that empowers parents, guardians, pupils, and
9families of children
served by the local educational agency to
10become active leaders through diverse channels for participation,
11including, but not limited to, schoolsite committees and councils;
12school district or county office of education committees and
13councils; English learner advisory committees; parent,
guardian,
14teacher, or pupil associations; and other advisory bodies that
15involve parents, guardians, pupils, or families.
16(C) Programs and activities that promote parent and family
17engagement of children served by the local educational agency in
18
school, support parents and guardians as their childrens’ first
19teachers, develop parent and guardian leaders, and encourage
20parents and guardians to advocate for a complete education that
21includes a full curriculum to close the access, achievement, and
22opportunities gaps.
23(D) For county offices of education only, active and meaningful
24participation, as described in subparagraphs (A) to (C), inclusive,
25and activities for purposes of serving parents, guardians, and
26families in state subsidized infant and toddler programs, early
27childhood education programs, state and local preschools, and
28child care and development programs serving children from birth
29to five years of age, inclusive, and active and meaningful
outreach
30to parents, guardians, and families who may benefit from
31countywide training and support services offered by the county
32office of education.

(A) Active and meaningful participation and training of parents,
34guardians, pupils, and families of children served by local
35educational agencies in the development and updating of local
36control and accountability plans required pursuant to Article 4.5
37(commencing with Section 52060) of Chapter 6.1, involvement at
38the schoolsite, school district, or county office of education level
39that empowers parents and guardians to become active leaders
40on local advisory bodies, and empowerment and support to
P4 1advocate for a complete education that includes a full curriculum
2and other services to close the access, achievement, and
3opportunity gaps. The plan may
include activities to help teachers
4and other school personnel improve teacher-parent or guardian
5and school-parent or guardian communication and create a
6welcoming environment for parent and guardian participation.

(B) Strategies, programs, and activities that promote parents,
8guardians, and families to directly engage with their child or
9children to promote pupil success academically, socially, and
10emotionally, including, but not limited to, how to become your
11child’s first teacher, shared reading, developing a strong
12teacher-parent or guardian partnership, how to discuss and
13support your child’s activities, studies, and homework, and how
14to effectively navigate and understand the public school system.
15(2) Once the plan is adopted, a local educational agency shall
16post its plan on its Internet Web site.
17(b) (1) If a local educational agency accepts funds appropriated
18in the annual Budget Act for purposes of this section, as a condition
19of receiving those funds, a school district, county office of
20education, or charter school shall do all of the following:
21(A) Develop a plan that aligns to the local control and
22accountability plans required pursuant to Article 4.5 (commencing
23with Section 52060) of Chapter 6.1 or the requirements of clause
24(ii) of subparagraph (A) of paragraph (5) of subdivision (b) of
25Sections 47605 and 47605.6 and all applicable deadlines that
26delineates how funds apportioned for purposes of this section, if
27they are apportioned, shall be spent.
28(B) The plan shall be developed using
research-based family
29engagement practices and
standards.
30(C) The plan shall include outreach in multiple languages if 15
31percent or more of the pupils enrolled in a public school that
32provides instruction in kindergarten or any of grades 1 to 12,
33inclusive, speak a single primary language other than English, as
34determined pursuant to Section 48985. The plan shall also include
35outreach to parents, guardians, and families that are
36underrepresented in the school, school district, or county office of
37education, and outreach strategies that are diverse and innovative.
38(D) The plan shall also include the estimated target for the
39number of parents, guardians, pupils, and families who will receive
40training and support services.
P5 1(E) The plan shall be
explained in a public meeting of the
2governing board of the school district, county board of education,
3or governing body of the charter school before its adoption in a
4subsequent public meeting.
5(2) Once the plan is adopted, a local educational agency shall
6post its plan on its Internet Web site.
7(c) Local educational agencies may use the funding received
8pursuant to this section to support the development and
9implementation of the plan pursuant to subdivision (a), including,
10but not limited to, either of the following ways:
11(1) Active and meaningful strategies related to the use of
12computing devices and the Internet as a tool for accessing
13information, training, and support relevant to the proposed
14engagement
plan.
15(2) Active and meaningful participation and training for teachers,
16classified employees, governing board members, and administrators
17to develop a deeper understanding regarding effective parent,
18guardian, and family engagement in order to work effectively with
19parents, guardians, pupils, and families as partners.
20(d) If funds are appropriated for purposes of this section in the
21annual Budget Act, a local educational agency may request funding
22from the Superintendent on or before June 1, 2017, and shall
23expend those funds between the 2016-17 fiscal year and the
242018-19 fiscal year, inclusive. The funds shall be intended to
25supplement, not supplant, funds used by the
local educational
26agency for parent, guardian, pupil, and familybegin delete engagement.end delete

30(e) For purposes of making the computations required by Section
318 of Article XVI of the California Constitution, if funds are
32appropriated in the annual Budget Act for purposes of this section,
33the funds shall be deemed to be “General Fund revenues
34appropriated for school districts,” as defined in subdivision (c) of
35Section 41202, for the fiscal year in which they are appropriated,
36and included within the “total allocations to school districts and
37
community college districts from General Fund proceeds of taxes
38appropriated pursuant to Article XIII B,” as defined in subdivision
P6 1(e) of Section 41202, for the fiscal year in which they are
2appropriated.
