An act to add Section 368.7 to the Penal Code, relating to elder and dependent adult abuse.

LEGISLATIVE COUNSEL’S DIGEST

AB 2721, as introduced, Rodriguez. Elder and dependent adult fraud: informational notice.

Existing law makes it a crime for a person who is not a caretaker to violate specified laws proscribing theft, embezzlement, fraud, or identity theft with respect to the property or identifying information of an elder or dependent adult, as defined, if the person knows or reasonably should know that the person is an elder adult.

This bill would require the Department of Justice to develop and distribute an informational notice that warns the public about elder and dependent adult fraud and provides information regarding how and where to file complaints. The bill would also require the notice to be made available on the Internet Web site of the Attorney General.

The people of the State of California do enact as follows:

SECTION 1.  

Section 368.7 is added to the Penal Code, to read:

368.7.  

The Department of Justice shall develop and distribute

4dependent adult fraud and directs them to information and
P2    1resources necessary to determine whether they are victims of fraud.
2The notice shall provide information regarding how and where to
3file complaints. The notice shall also be made available on the
4Internet Web site of the Attorney General.
