Existing law generally grants state employees the right to form, join, and participate in the activities of employee organizations of their own choosing for the purpose of representation on all matters of employer-employee relations. Existing law prescribes procedures in this regard for different public employers and occupational classifications, both state and local.
This bill would require an organization that provides representation to public employees in labor negotiations with a state or local public employer to place an itemized version of its budget on its Internet Web site and to provide each member of the organization easy access to it. The bill would require the budget to be updated on an ongoing basis. The bill would also require a public employee organization to provide its members a means of asking questions about financial issues related to the organization and would grant members the right to receive responses to their questions, in writing if requested, within a reasonable time.

The people of the State of California do enact as follows:
Chapter 13 (commencing with Section 3599.1)
2is added to Division 4 of Title 1 of the Government Code, to read:

(a) For purposes of this section:
7(1) “Public employee organization” means an organization that
8provides representation to public employees in labor negotiations
9with a public employer regarding the terms and conditions of
10employment.
11(2) “Public employer” means any public employer, including,
12but not limited to, an employer subject to Chapter 10 (commencing
13with Section 3500), Chapter 10.3 (commencing with Section 3512),
14Chapter 10.5 (commencing with Section 3525), Chapter 10.7
15(commencing with Section 3540), or Chapter 12 (commencing
16with Section 3560), Chapter 7 (commencing with Section 71600)
17of Title 8, and Chapter 7.5 (commencing with Section 71800) of
18this code, and
Chapter 7 (commencing with Section 99560) of Part
1911 of Division 10 of the Public Utilities Code.
20(b) On and after January 1, 2017, a public employee organization
21shall place an itemized version of its budget on its Internet Web
22site and shall provide each member of the organization easy access
23to the budget so published. The budget shall be updated on an
24ongoing basis.
25(c) A public employee organization shall provide its members
26a means of asking questions about financial issues related to the
27organization, including the budget described in subdivision (b),
28and members shall have the right to receive a response to their
29questions, in writing if requested, within a reasonable time.
