Existing law establishes various housing programs directed by the Department of Housing and Community Development (HCD), including special housing programs to provide housing assistance for persons with developmental and physical disabilities and persons with mental health disorders. Existing law provides for the Medi-Cal program, which is administered by the State Department of Health Care Services (DHCS), under which qualified low-income individuals receive health care services. The Medi-Cal program is, in part, governed and funded by federal Medicaid program provisions.
This bill would requirebegin delete HCD, in coordination with DHCS,end deletebegin insert HCDend insert to, on or beforebegin delete July

The bill would require an applicant
awarded a grant to use the funds for specified purposes, including long-term rental assistance and interim housing. The bill would provide that a county resident is eligible to receive assistance pursuant to a grant awarded under thebegin delete Medi-Cal Housing Programend deletebegin insert programend insert if he or she meets specified requirements, including that the person is homeless, is a Medi-Cal beneficiary, is eligible for Supplemental Security Income,begin delete andend delete is eligible to receivebegin delete services under the Whole Person Care pilot or the Health Home Program.end deletebegin insert
certain services, and is likely to improve his or her health with supportive services.end insert The bill would provide that the program shall be funded upon appropriation by the Legislature. The bill would also authorizebegin delete HCD and DHCS,end deletebegin insert HCD,end insert for purposes of implementing these provisions, to enter into exclusive or nonexclusive contracts on a bid or negotiated basis, exempt from specified small business procurement, personal service, and public contracting provisions, and exempt from the review or approval of any division of the Department of General Services.begin delete The bill would also prohibit HCD and DHCS from implementing provisions
developed pursuant to these provisions until necessary federal approvals have been obtained and to the extent that other federal financial participation is not jeopardized.end deletebegin insert The bill would exempt the program guidelines created by the department from requirements prescribed for administrative regulations. The bill would require HCD to analyze data collected pursuant to the program, as specified, and by October 1, 2019, and subsequently as the program may be funded, to report program data to certain legislative committees, as specified.end insert The bill would condition implementation of these provisions upon an appropriation provided for this purpose.

The people of the State of California do enact as follows:
The Legislature finds and declares all of the
2following:
3(a) Homeless beneficiaries incur disproportionate Medi-Cal
4costs, particularly people experiencing chronic homelessness and
5people who cycle between homelessness, emergency departments,
6inpatient care, and nursing home stays. Supportive housing, which
7is affordable housing with intensive services, allows people
8experiencing significant barriers to housing stability to improve
9their health and decrease their Medicaid costs. National studies
10comparing formerly homeless Medicaid beneficiaries living in
11supportive housing with homeless beneficiaries receiving usual
12care demonstrate
Medicaid cost savings of almost $9,000 per year
13after the costs of services.
14(b) In the proposal to renew California’s Section 1115 Medicaid
15Waiver, “Medi-Cal 2020: Key Concepts for Renewal,” the State
16Department of Health Care Services (DHCS) stated, “Research
17suggests that individuals experiencing homelessness, particularly
18those individuals with multiple chronic conditions, often struggle
19to receive appropriate health care services and are
20disproportionately likely to be high utilizers of the health care
21safety net.” DHCS proposed using Medi-Cal to fund the tools
22communities need to help homeless beneficiaries gain access to
P4 1and maintain housing stability, including the costs of interim
2housing, recuperative/respite care, and long-term rental subsidies.
3(c) The final Medi-Cal
2020 Waiver allows participating entities,
4including counties, to create Whole Person Care pilots to address
5the health, behavioral health, and social services needs of high
6users of multiple systems. Participating entities will be able to use
7Whole Person Care pilots to offer housing-related services to
8homeless residents, form collaborations between local agencies
9and health plans to address service needs of homeless beneficiaries,
10pool waiver and other sources of financing to pay for services
11promoting housing stability, and collect data on residents’
12outcomes.
13(d) Though the federal Centers for Medicare and Medicaid
14Services disallowed federal financial participation in the costs of
15housing interventions, the final Section 1115 Medicaid Waiver
16special terms and conditions, referred to as the “Medi-Cal 2020
17Waiver,” allow for
state contributions to Whole Person Care
18“county housing pools” to fund long-term costs of housing to
19achieve the goals of the Waiver proposal. The final Waiver special
20terms and conditions also permit leveraging local resources to
21increase access to subsidized housing units. They may also
22incorporate a financing component to reallocate or reinvest a
23portion of the savings from the reduced utilization of health care
24services into the housing pool.

17this section. Eligibility does not create an entitlement to grant funds
18and is subject to availability of funds. The applicant shall meet all
19of the following requirements:

21(1) Is a lead agency participating in a Whole Person Care pilot
22designed to provide services to people experiencing homelessness.
23(2) Is a lead agency that previously participated in a Whole
24Person Care pilot that has expired and the applicant has decided
25to continue to provide services to homeless people under the
26
structures developed in the Whole Person Care pilot.
27(3) Is located in a county with a Medi-Cal managed care plan
28or plans participating in the Health Home Program.

12(d) A county’s administrative costs for up to 3 percent of the
13total grant awarded.
A county resident is eligible to receive assistance
16pursuant to a grant awarded under thebegin delete Medi-Cal Housing Programend delete
17begin insert programend insert if he or she meets all of the following requirements:
18(a) Is homeless upon initial eligibility.
19(b) Is a Medi-Cal beneficiary.
20(c) Is eligible for Supplemental Security Income.
21(d) Is eligible to receive services under
either the Whole Person
22Care pilot or the Health Home Program, whichever is operative
23in the participating county or region.

(d) Is eligible to receive services under a program providing
25services promoting housing stability, including, but not limited to,
26the following:
27
(1) The Whole Person Care pilot program.
28
(2) Health Home Program.
29
(3) A locally controlled services program funding or providing
30services in supportive housing.
31(e) Is likely to improve his or her health conditions with
32supportive housing.

35funded upon appropriation by the Legislature. The Legislature
36shall consider the impact that housing and supportive services have
37had in changing utilization and health care costs, as identified in
38the evaluation described in Sectionbegin delete 53571,end deletebegin insert

39eligible participants into supportive housing.
HCD shall reimburse DHCS for the costs of
3collaborating inbegin delete the design and implementation of the program.end delete
4begin insert matching and providing relevant data.end insert HCD shall use no more
5than 5 percent of the funds appropriated for thebegin delete Medi-Cal Housing begin insert programend insert
for purposes of administering the program.

(a) For purposes of implementing this part, HCDbegin delete or may enter into exclusive or nonexclusive contracts on a
9DHCSend delete
10bid or negotiated basis. Contracts entered into or amended pursuant
11to this subdivision shall be exempt from Chapter 6 (commencing
12with Section 14825) of Part 5.5 of Division 3 of Title 2 of the
13Government Code, Section 19130 of the Government Code, and
14Part 2 (commencing with Section 10100) of Division 2 of the
15Public Contract Code and shall be exempt from the review
or
16approval of any division of the Department of General Services.
17(b) HCD and DHCS shall implement the provisions developed
18pursuant to this part only after all necessary federal approvals have
19been obtained for the Health Home Program and to the extent that
20other federal financial participation is not jeopardized.

(b) Any guidelines that are adopted, amended, or repealed to
22implement this chapter shall not be subject to Chapter 3.5
23(commencing with Section 11340) of Part 1 of Division 3 of Title
242 of the Government Code.
Implementation of this part shall be contingent on an
27appropriation provided for this purpose in the annual Budget Act
28or other measure.
