An act to add Section 60605.13 to the Education Code, relating to pupil instruction.

AB 2862, as amended, O'Donnell. Pupil instruction: visual and performing arts: revision of content standards.

Existing law requires the State Board of Education, on or before June 1, 2001, to adopt content standards in the curriculum area of visual and performing arts pursuant to recommendations developed by the Superintendent of Public Instruction.

This bill would require the Superintendent, in consultation with the Instructional Quality Commission, to recommend revisions to the visual and performing arts content standards in certain subjects to the state board, and would require the state board to adopt, reject, or modify the recommendations on or before January 31, 2019. The bill would require the Superintendent, in consultation with the Instructional Quality Commission and the state board, to select a group of experts in visual and performing arts for purposes of assisting the Superintendent in developing recommendations under the bill.begin delete Theend delete

The bill would require the Superintendent, in consultation with the Instructional Quality Commission, to hold a minimum of 2 public hearings in order for the public to provide input on the Superintendent’s recommendations, and would require the state board to adopt, reject, or modify the recommendations at a subsequent public meeting, in accordance with specified procedures.

The bill would also provide, if the visual and performing arts content standards are adopted pursuant to the bill: (1) that the state board would be required to consider the adoption of a curriculum framework and evaluation criteria for instructional materials that are aligned to the visual and performing arts content standards no later than July 31, 2020, as specified; and (2) that the state board would be authorized to adopt instructional materials for kindergarten and grades 1 to 8, inclusive, that are aligned to the visual and performing arts content standards no later than November 30, 2021, as specified.

SECTION 1.  

Section 60605.13 is added to the Education Code,
2to read:

60605.13.  

(a) The Superintendent, in consultation with the
4Instructional Quality Commission, shall recommend to the state
5board revisions to the visual and performing arts content standards
6in the subjects of dance, theater, music, and visual arts adopted by
7the state board pursuant to Section 60605.1.

8(b) In consultation with the Instructional Quality Commission
9and the state board, the Superintendent shall select a group of
10experts in visual and performing arts for purposes of assisting the
11Superintendent in developing recommendations pursuant to this
P3    1section. A majority of this group of experts shall be current public
2school elementary or secondary classroom teachers who have a
3professional teaching credential that is valid under state law.

4(c) The National Core Arts Standards in the subjects of dance,
5theater, music, and visual arts developed by the National Coalition
6for Core Arts Standards shall serve as the basis for deliberations
7regarding revisions to the visual and performing arts content
8standards.

9(d) (1) The Superintendent, in consultation with the Instructional
10Quality Commission, shall hold a minimum of two public hearings
11in order for the public to provide input on the revisions
12recommended pursuant to this section and the state board shall
13adopt, reject, or modify those recommendations at a subsequent
14public meeting.

15(2) The public hearings and meetings required by this
16subdivision shall be held pursuant to the Bagley-Keene Open
17Meeting Act (Article 9 (commencing with Section 11120) of
18Chapter 1 of Part 1 of Division 3 of Title 2 of the Government
19Code).

20(e) On or before November 30, 2018, the Superintendent shall
21present to the state board the revised visual and performing arts
22content standards, based on the work of the group of experts
23convened pursuant to subdivision (b), conducted in consultation
24with the Instructional Quality Commission.

25(f) (1) On or before January 31, 2019, the state board shall
26adopt, reject, or modify any revisions to the visual and performing
27arts standards recommended by the Superintendent. If the state
28board modifies the revisions recommended by the Superintendent,
29the state board shall explain, in writing, the reasons for modifying
30the recommended revised content standards to the Governor and
31the Legislature.

32(2) If the state board modifies the visual and performing arts
33content standards recommended by the Superintendent pursuant
34to subdivision (e), the state board shall, in a meeting conducted
35pursuant to the Bagley-Keene Open Meeting Act (Article 9
36(commencing with Section 11120) of Chapter 1 of Part 1 of
37Division 3 of Title 2 of the Government Code), provide written
38reasons for its revisions. The state board shall not adopt revised
39visual and performing arts content standards at the same meeting
40it provides its written reasons, but, instead, shall adopt these
P4    1revisions at a subsequent meeting conducted no later than March
231, 2019.

3(3) If the state board rejects the visual and performing arts
4content standards recommended by the Superintendent pursuant
5to subdivision (e), the state board shall transmit to the
6Superintendent, the Governor, and the appropriate policy and fiscal
7committees of the Legislature a specific written explanation of the
8reasons for the rejection of the standards presented by the
9Superintendent.

(g) If the visual and performing arts content standards are
11adopted pursuant to subdivision (f), the state board shall consider
12the adoption of a curriculum framework and evaluation criteria
13for instructional materials that are aligned to the visual and
14performing arts content standards no later than July 31, 2020,
15based on recommendations of the Instructional Quality
16Commission.

(h) If the visual and performing arts content standards are
18adopted pursuant to subdivision (f), the state board may adopt
19instructional materials for kindergarten and grades 1 to 8,
