An act to amend Section 4465 of the Government Code, relating to disability access.

The federal Americans with Disabilities Act of 1990 and the California Building Standards Code require that specified buildings, structures, and facilities be accessible to, and usable by, persons with disabilities. Existing law establishes a Disability Access and Education Revolving Fund within the Division of the State Architect for purposes of increasing disability access and compliance with construction-related accessibility requirements and developing educational resources for businesses to facilitate compliance with federal and state disability laws, as specified.

This bill would make a nonsubstantive change.

The people of the State of California do enact as follows:

SECTION 1.  

Section 4465 of the Government Code is amended
2to read:

4465.  

(a) There is hereby established in the Division of the
4State Architect a Disability Access and Education Revolving Fund,
5as set forth in Section 4470, for the purpose of increasing disability
P2    1access and compliance with construction-related accessibility
2requirements by the following means:

3(1) Increasing the number of private and public certified access
4specialists available to assist building owners and tenants to
5understand and comply with construction-related accessibility
6requirements by using some of the funds to moderate some of the
7costs of certification and testing.

8(2) Establishing and maintaining oversight of the certified access
9specialist program, including, but not limited to, adopting best
10 practices guidelines for certified access specialists, providing
11continuing education on construction-related accessibility
12requirements, and performing its audit and discipline functions
13under Sections 4459.7 and 4459.8.

14(3) Increasing outreach efforts and developing educational
15resources for persons with disabilities and businesses to facilitate
16compliance with the federal Americans with Disabilities Act of
171990 (42 U.S.C. Sec. 12101 et seq.), the Unruh Civil Rights Act
18(Section 51 of the Civil Code), and Title 24 of the California Code
19of Regulations, as they relate to providing full and equal access to
20public facilities for persons with disabilities.

21(b) In developing educational resources with this fund, emphasis
22shall be placed on the development and dissemination of
23educational materials, such asbegin insert modules,end insert toolkits,begin delete modules,end delete and
24checklists, as appropriate, to facilitate a commercial property
25owner’s or tenant’s understanding of, and compliance with, the
26construction-related accessibility requirements.

27(c) In developing and disseminating educational resources with
28this fund, the Division of the State Architect shall consult and work
29with the Department of Rehabilitation and the California
30Commission on Disability Access, and may contract with those
31agencies to develop educational resources. It is the intent of the
32Legislature that any development or dissemination of educational
33resources under this section shall be coordinated with educational
34efforts by other state agencies so as to expand the reach and
35effectiveness of each effort or the combined efforts.
