(1) Existing law requires the publication of notice in set boundaries known as judicial districts in different contexts, including in connection with lien sales and sales pursuant to a mortgage or deed of trust. Existing law provides for the preservation of judicial districts following the unification of municipal and superior courts.

This bill would repeal provisions regarding the preservation of judicial districts, described above, and would establish public notice districts as the place for the publication of notice. The bill would also make conforming revisions to statutes requiring publication of notice in former judicial districts.

(2) Existing law defines a hosting platform as a marketplace that is created to facilitate the rental of a residential unit for tourist or transient use for compensation and from which the operator of the hosting platform derives revenues, as specified. Existing law requires a hosting platform to provide a specific notice to occupants listing their rooms, homes, condominiums, or apartments for short-term rental.

This bill would require hosting platforms for short-term rentals to provide notice, as described above, to mobilehome occupants.

(3) Existing law requires the Controller to establish and supervise a uniform accounting system, including a system of audits, to ensure the proper distribution and accounting of all fines, penalties, forfeitures, and fees assessed by courts.

This bill would require the Controller to establish and maintain trial court revenue distribution guidelines, including a program to audit the accuracy of distributions, to ensure that fines, penalties, forfeitures, and fees assessed by the court are collected and properly accounted for and disbursed. The bill would also make technical and conforming changes.

9proceeds of the sale on the occupant’s behalf. The occupant, or
10any other person having a court order or other judicial process
11against the property, may claim the excess proceeds, or a portion
12thereof sufficient to satisfy the particular claim, at any time within
13one year of the date of sale. Thereafter, the owner shall pay any
14remaining excess proceeds to the treasury of the county in which
15the sale was held.

29determine whether your lease or contract contains restrictions that

32 condominium, or apartment may be a violation of your lease or
33contract, and could result in legal action against you by your
34landlord, including possible eviction.

(a) As used in this section and Sections 2924g and
382924h, “property” means real property or a leasehold estate therein,

2of property can be made under the power of sale contained in any
3deed of trust or mortgage, or any resale resulting from a rescission
4for a failure of consideration pursuant to subdivision (c) of Section

6notice of the time of sale and of the street address and the specific
7place at the street address where the sale will be held, and
8describing the property to be sold, at least 20 days before the date
9of sale in one public place in the city where the property is to be

35(3) A copy of the notice of sale shall also be posted in a
36conspicuous place on the property to be sold at least 20 days before
37the date of sale, where possible and where not restricted for any
38reason. If the property is a single-family residence the posting shall
39be on a door of the residence, but, if not possible or restricted, then
40the notice shall be posted in a conspicuous place on the property;
P5    1however, if access is denied because a common entrance to the
2property is restricted by a guard gate or similar impediment, the
3property may be posted at that guard gate or similar impediment
4to any development community.

5(4) The notice of sale shall conform to the minimum
6requirements of Section 6043 of the Government Code and be
7recorded with the county recorder of the county in which the
8property or some part thereof is situated at least 20 days prior to
9the date of sale.

10(5) The notice of sale shall contain the name, street address in
11this state, which may reflect an agent of the trustee, and either a
12toll-free telephone number or telephone number in this state of the
13trustee, and the name of the original trustor, and also shall contain
14the statement required by paragraph (3) of subdivision (c). In
15addition to any other description of the property, the notice shall
16describe the property by giving its street address, if any, or other
17common designation, if any, and a county assessor’s parcel
18number; but if the property has no street address or other common
19designation, the notice shall contain a legal description of the
20property, the name and address of the beneficiary at whose request
21the sale is to be conducted, and a statement that directions may be
22obtained pursuant to a written request submitted to the beneficiary
23within 10 days from the first publication of the notice. Directions
24shall be deemed reasonably sufficient to locate the property if
25information as to the location of the property is given by reference
26to the direction and approximate distance from the nearest
27crossroads, frontage road, or access road. If a legal description or
28a county assessor’s parcel number and either a street address or
29another common designation of the property is given, the validity
30of the notice and the validity of the sale shall not be affected by
31the fact that the street address, other common designation, name
32and address of the beneficiary, or the directions obtained therefrom
33are erroneous or that the street address, other common designation,
34name and address of the beneficiary, or directions obtained
35therefrom are omitted.

36(6) The term “newspaper of general circulation,” as used in this
37section, has the same meaning as defined in Article 1 (commencing
38with Section 6000) of Chapter 1 of Division 7 of Title 1 of the
39Government Code.

P6    1(7) The notice of sale shall contain a statement of the total
2amount of the unpaid balance of the obligation secured by the
3property to be sold and reasonably estimated costs, expenses,
4advances at the time of the initial publication of the notice of sale,
5and, if republished pursuant to a cancellation of a cash equivalent
6pursuant to subdivision (d) of Section 2924h, a reference of that
7fact; provided, that the trustee shall incur no liability for any good
8faith error in stating the proper amount, including any amount
9provided in good faith by or on behalf of the beneficiary. An
10inaccurate statement of this amount shall not affect the validity of
11any sale to a bona fide purchaser for value, nor shall the failure to
12post the notice of sale on a door as provided by this subdivision
13affect the validity of any sale to a bona fide purchaser for value.

14(8) (A) On and after April 1, 2012, if the deed of trust or
15mortgage containing a power of sale is secured by real property
16containing from one to four single-family residences, the notice
17of sale shall contain substantially the following language, in
18addition to the language required pursuant to paragraphs (1) to (7),
19inclusive:


21NOTICE TO POTENTIAL BIDDERS: If you are considering
22bidding on this property lien, you should understand that there are
23risks involved in bidding at a trustee auction. You will be bidding
24on a lien, not on the property itself. Placing the highest bid at a
25trustee auction does not automatically entitle you to free and clear
26ownership of the property. You should also be aware that the lien
27being auctioned off may be a junior lien. If you are the highest
28bidder at the auction, you are or may be responsible for paying off
29all liens senior to the lien being auctioned off, before you can
30receive clear title to the property. You are encouraged to investigate
31the existence, priority, and size of outstanding liens that may exist
32on this property by contacting the county recorder’s office or a
33title insurance company, either of which may charge you a fee for
34this information. If you consult either of these resources, you
35should be aware that the same lender may hold more than one
36mortgage or deed of trust on the property.


38NOTICE TO PROPERTY OWNER: The sale date shown on
39this notice of sale may be postponed one or more times by the
40mortgagee, beneficiary, trustee, or a court, pursuant to Section
P7    12924g of the California Civil Code. The law requires that
2information about trustee sale postponements be made available
3to you and to the public, as a courtesy to those not present at the
4sale. If you wish to learn whether your sale date has been
5postponed, and, if applicable, the rescheduled time and date for
6the sale of this property, you may call [telephone number for
7information regarding the trustee’s sale] or visit this Internet Web
8site [Internet Web site address for information regarding the sale
9of this property], using the file number assigned to this case [case
10file number]. Information about postponements that are very short
11in duration or that occur close in time to the scheduled sale may
12not immediately be reflected in the telephone information or on
13the Internet Web site. The best way to verify postponement
14information is to attend the scheduled sale.


16(B) A mortgagee, beneficiary, trustee, or authorized agent shall
17make a good faith effort to provide up-to-date information
18regarding sale dates and postponements to persons who wish this
19information. This information shall be made available free of
20charge. It may be made available via an Internet Web site, a
21telephone recording that is accessible 24 hours a day, seven days
22a week, or through any other means that allows 24 hours a day,
23seven days a week, no-cost access to updated information. A
24disruption of any of these methods of providing sale date and
25postponement information to allow for reasonable maintenance or
26due to a service outage shall not be deemed to be a violation of
27the good faith standard.

28(C) Except as provided in subparagraph (B), nothing in the
29wording of the notices required by subparagraph (A) is intended
30to modify or create any substantive rights or obligations for any
31person providing, or specified in, either of the required notices.
32Failure to comply with subparagraph (A) or (B) shall not invalidate
33any sale that would otherwise be valid under Section 2924f.

34(D) Information provided pursuant to subparagraph (A) does
35not constitute the public declaration required by subdivision (d)
36of Section 2924g.

37(9) If the sale of the property is to be a unified sale as provided
38in subparagraph (B) of paragraph (1) of subdivision (a) of Section
399604 of the Commercial Code, the notice of sale shall also contain
40a description of the personal property or fixtures to be sold. In the
P8    1case where it is contemplated that all of the personal property or
2fixtures are to be sold, the description in the notice of the personal
3property or fixtures shall be sufficient if it is the same as the
4description of the personal property or fixtures contained in the
5agreement creating the security interest in or encumbrance on the
6personal property or fixtures or the filed financing statement
7relating to the personal property or fixtures. In all other cases, the
8description in the notice shall be sufficient if it would be a
9sufficient description of the personal property or fixtures under
10Section 9108 of the Commercial Code. Inclusion of a reference to
11or a description of personal property or fixtures in a notice of sale
12hereunder shall not constitute an election by the secured party to
13conduct a unified sale pursuant to subparagraph (B) of paragraph
14(1) of subdivision (a) of Section 9604 of the Commercial Code,
15shall not obligate the secured party to conduct a unified sale
16pursuant to subparagraph (B) of paragraph (1) of subdivision (a)
17of Section 9604 of the Commercial Code, and in no way shall
18render defective or noncomplying either that notice or a sale
19pursuant to that notice by reason of the fact that the sale includes
20none or less than all of the personal property or fixtures referred
21to or described in the notice. This paragraph shall not otherwise
22affect the obligations or duties of a secured party under the
23Commercial Code.

24(c) (1) This subdivision applies only to deeds of trust or
25mortgages which contain a power of sale and which are secured
26by real property containing a single-family, owner-occupied
27residence, where the obligation secured by the deed of trust or
28mortgage is contained in a contract for goods or services subject
29to the provisions of the Unruh Act (Chapter 1 (commencing with
30Section 1801) of Title 2 of Part 4 of Division 3).

31(2) Except as otherwise expressly set forth in this subdivision,
32all other provisions of law relating to the exercise of a power of
33sale shall govern the exercise of a power of sale contained in a
34deed of trust or mortgage described in paragraph (1).

35(3) If any default of the obligation secured by a deed of trust or
36mortgage described in paragraph (1) has not been cured within 30
37days after the recordation of the notice of default, the trustee or
38mortgagee shall mail to the trustor or mortgagor, at his or her last
39known address, a copy of the following statement:

10(4) All sales of real property pursuant to a power of sale
11contained in any deed of trust or mortgage described in paragraph
12(1) shall be held in the county where the residence is located and
13shall be made to the person making the highest offer. The trustee
14may receive offers during the 10-day period immediately prior to
15the date of sale and if any offer is accepted in writing by both the
16trustor or mortgagor and the beneficiary or mortgagee prior to the
17time set for sale, the sale shall be postponed to a date certain and
18prior to which the property may be conveyed by the trustor to the
19person making the offer according to its terms. The offer is
20revocable until accepted. The performance of the offer, following
21acceptance, according to its terms, by a conveyance of the property
22to the offeror, shall operate to terminate any further proceeding
23under the notice of sale and it shall be deemed revoked.

24(5) In addition to the trustee fee pursuant to Section 2924c, the
25trustee or mortgagee pursuant to a deed of trust or mortgage subject
26to this subdivision shall be entitled to charge an additional fee of
27fifty dollars ($50).

28(6) This subdivision applies only to property on which notices
29of default were filed on or after the effective date of this
30subdivision.

31(d) With respect to residential real property containing no more
32than four dwelling units, a separate document containing a
33summary of the notice of sale information in English and the
34languages described in Section 1632 shall be attached to the notice
35of sale provided to the mortgagor or trustor pursuant to Section
362923.3.

This chapter does not apply to any of the following:

39(a) Things in action.

40(b) Ships or cargoes if either are at sea or in a foreign port.

2promissory notes governed by the Uniform Commercial Code,
3security interests, and contracts of bottomry or respondentia.

4(d) Wines or brandies in the wineries, distilleries, or wine cellars
5of the makers or owners of the wines or brandies, or other persons
6having possession, care, and control of the wines or brandies, and
7the pipes, casks, and tanks in which the wines or brandies are
8 contained, if the transfers are made in writing and executed and
9acknowledged, and if the transfers are recorded in the book of
10official records in the office of the county recorder of the county
11in which the wines, brandies, pipes, casks, and tanks are situated.

12(e) A transfer or assignment made for the benefit of creditors
13generally or by an assignee acting under an assignment for the
14benefit of creditors generally.

15(f) Property exempt from enforcement of a money judgment.

16(g) Standing timber.

17(h) Subject to the limitations in Section 3440.3, a transfer of
18personal property if all of the following conditions are satisfied:

19(1) Before the date of the intended transfer, the transferor or the
20transferee files a financing statement, with respect to the property
21transferred, authorized in an authenticated record by the transferor.
22The financing statement shall be filed in the office of the Secretary
23of State in accordance with Chapter 5 (commencing with Section
249501) of Division 9 of the Commercial Code, but may use the
25terms “transferor” in lieu of “debtor” and “transferee” in lieu of
26“secured party.” The provisions of Chapter 5 (commencing with
27Section 9501) of Division 9 of the Commercial Code shall apply
28as appropriate to the financing statement.

29(2) The transferor or the transferee publishes a notice of the
30intended transfer one time in a newspaper of general circulation
31published in thebegin delete judicialend deletebegin insert public noticeend insert district in which the personal
32property is located, if there is one, and if there is none in the
33begin delete judicialend deletebegin insert public noticeend insert district, then in a newspaper of general

The publication shall be
36completed not less than 10 days before the date the transfer occurs.
37The notice shall contain the name and address of the transferor
38and transferee and a general statement of the character of the
39personal property intended to be transferred, and shall indicate the

2which the transfer is to be made.

3(i) Personal property not located within this state at the time of
4the transfer or attachment of the lien if the provisions of this
5subdivision are not used for the purpose of evading this chapter.

6(j) A transfer of property that (1) is subject to a statute or treaty
7of the United States or a statute of this state that provides for the
8registration of transfers of title or issuance of certificates of title
9and (2) is so far perfected under that statute or treaty that a bona
10fide purchaser cannot acquire an interest in the property transferred
11that is superior to the interest of the transferee.

12(k) A transfer of personal property in connection with a
13transaction in which the property is immediately thereafter leased
14by the transferor from the transferee provided the transferee
15purchased the property for value and in good faith pursuant to
16subdivision (c) of Section 10308 of the Commercial Code.

17(l) Water supply property, as defined in Section 849 of the Public
18Utilities Code.

19(m) A transfer of property by any governmental entity.

(a) This chapter does not affect the rights of a secured
25party who, for value and in good faith, acquires a security interest
26in the transferred personal property from the transferee, or from
27the transferee’s successor in interest, if the transferor is no longer
28in possession of the personal property at the time the security
29interest attaches.

30(b) Additionally, except as provided in Section 3440.3, this
31chapter does not affect the rights of a secured party who acquires
32a security interest from the transferee, or from the transferee’s
33successor in interest, in the personal property, if all of the following
34conditions are satisfied:

35(1) On or before the date the security agreement is executed,
36the intended debtor or secured party files a financing statement
37with respect to the property transferred, signed by the intended
38debtor. The financing statement shall be filed in the office of the
39Secretary of State in accordance with Chapter 5 (commencing with
40Section 9501) of Division 9 of the Commercial Code, but shall
P12   1use the terms “transferor” in lieu of “debtor,” “transferee” in lieu
2of “secured party,” and “secured party” in lieu of “assignee of
3secured party.” The provisions of Chapter 5 (commencing with
4Section 9501) of Division 9 of the Commercial Code shall apply

(a) Notice of sale of an interest in real property shall
39be in writing, shall state the date, time, and place of sale, shall
40describe the interest to be sold, and shall give a legal description
P13   1of the real property and its street address or other common
2designation, if any. If the real property has no street address or
3other common designation, the notice of sale shall include a
4statement that directions to its location may be obtained from the
5levying officer upon oral or written request or, in the discretion of
6the levying officer, the notice of sale may contain directions to its
7location. Directions are sufficient if information as to the location
8of the real property is given by reference to the direction and
9approximate distance from the nearest crossroads, frontage road,
10or access road. If an accurate legal description of the real property
11is given, the validity of the notice and sale is not affected by the
12fact that the street address or other common designation, or
13directions to its location, are erroneous or omitted.

14(b) Not less than 20 days before the date of sale, notice of sale
15of an interest in real property shall be served, mailed, and posted
