          SUBJECT:  Transportation: omnibus bill


            DIGEST:  This bill makes non-controversial changes to sections  
          of law relating to transportation.

          ANALYSIS:
          
          According to the Legislative Analyst's Office, the cost of  
          producing a bill in 2001-2002 was $17,890.  By combining  
          multiple matters into one bill, the Legislature can make minor  
          changes to law in the most cost-effective manner.

          Proposals included in this transportation omnibus bill must  
          abide by the Committee policy on omnibus bills.  The proponent  
          of an item submits proposed language and provides background  
          materials to the committee for the item to be described to  
          legislative staff and stakeholders.  Committee staff provides a  
          summary of the items and the proposed statutory changes to all  
          majority and minority consultants in both the Senate and  
          Assembly, as well as all known or presumed interested parties.   
          If an item encounters any opposition and the proponent cannot  
          work out a solution with the opposition, the item is omitted  
          from or amended out of the bill.  Proposals in the bill must  
          reflect a consensus and be without opposition from legislative  
          members, agencies, and other stakeholders.

          This bill makes non-controversial changes to sections of law  
          relating to transportation.  Specifically, the bill includes the  
          following provisions.  The proponent of each provision is noted

          in brackets.

            1)  Corrects erroneous cross references in Sections 13532 and  
              13570 of the Business and Professions Code, relating to  
              motor vehicle fuel.  [California Department of Food and

            2)  Repeals an obsolete reporting requirement.  [California  
              Department of Food and Agriculture] 


            3)  Moves the code section establishing the California  
              Cultural and Historical Endowment License Plate Program from  
              the Education Code to the Vehicle Code.  [Assembly

            4)  Removes the requirement for the State Treasurer's office  
              to prepare a report on the State's GARVEE bonding capacity  
              on an annual basis, instead requiring a report when the  
              Department of Transportation anticipates the issuance of new  
              notes and makes a written request in conjunction with the  
              California Transportation Commission;  removes an obsolete

            5)  Makes multiple changes to Vehicle Code to achieve  
              conformance with federal regulations.  [California Highway

            6)  Explicitly permits the DMV to use revenues generated by  
              the Legacy License Plate Program to advertise the Program in  
              materials it mails to customers.  [Office of Assemblymember

            7)  Repeals a duplicative reference to the commemorative 1984  
              Olympic reflectorized license plates program.  [Department

            8)  Changes obsolete references to the Federal Highway  
              Administration to the appropriate federal entity.

            9)  Corrects an inconsistency in terms used to describe a  
              "parking invoice fee." [Office of Assemblymember Bonilla] 


            10) Corrects an erroneous cross reference in Section 22358.4  
              of the Vehicle Code.  [Safer Streets LA] 

            11) Clarifies that a vehicle parked on a roadway with an  
              adjacent curb or class IV bikeway must be within 18 inches  
              of the curb or edge of the class IV bikeway.  [California

            12) Deletes references to repealed code sections in Section  
              25802 of the Vehicle Code concerning exemptions from  
              lighting equipment requirements. [California Highway Patrol]  



            13) Makes a number of minor changes to bring existing law into  
              conformance with Federal Motor Carrier Safety Standards for  
              commercial vehicles and vehicles transporting hazardous  
              materials.  [California Highway Patrol] 


          COMMENTS:

          Purpose.  The purpose of omnibus bills is to include technical  
          and non-controversial changes to various committee-related  
          statutes into one bill.  This allows the legislature to make  
          multiple, minor changes to statutes in one bill in a  
          cost-effective manner.  The Assembly Transportation Committee  
          requires its transportation omnibus bill be a consensus measure.  
           If there is no consensus on a particular item, it cannot be  
          included.  There is no known opposition to any item in this  
          bill.
