An act to add Section 14670.08 to the Government Code, relating to developmental services.

SB 11, as introduced, Stone. Developmental services: developmental center closures.

Existing law vests in the State Department of Developmental Services jurisdiction over state hospitals referred to as developmental centers for the provision of residential care to individuals with developmental disabilities. Existing law requires the department to comply with procedural requirements when closing a developmental center, including submitting a detailed plan to the Legislature and holding at least one public hearing. Under existing law, the department allocates funds to private nonprofit entities known as regional centers, which are required to provide, or arrange for the provision of, services and supports for persons with developmental disabilities.

This bill would require the Department of Finance, upon the closure of the Sonoma Developmental Center, Fairview Developmental Center, or the nonsecured portion of the Porterville Developmental Center, to deposit the net savings from the closure of each center, as defined, into the Lanterman Act Community-Based Services Fund, s newly created fund. The bill would make the moneys in the fund available to the department, upon appropriation, to be used to supplement existing purchase-of-service funds used by regional centers to purchase services and supports for persons with developmental disabilities.

The people of the State of California do enact as follows:

SECTION 1.  

It is the intent of the Legislature, in enacting this
2act, to ensure that savings derived from the closures of the Fairview
3Developmental Center, Sonoma Developmental Center, and the
4nonsecured portion of the Porterville Developmental Center are
5used to supplement the funds available to purchase
6community-based services for persons with developmental
7disabilities.

SEC. 2.  

Section 14670.08 is added to the Government Code,
9to read:

14670.08.  

(a) Notwithstanding any other law, the Department
11of Finance shall, upon the closure of Sonoma Developmental
12Center, Fairview Developmental Center, or the nonsecured portion
13of the Porterville Developmental Center, pursuant to Section 4474.1
14of the Welfare and Institutions Code, deposit the net savings from
15the closure of each center into the Lanterman Act
16Community-Based Services Fund, which is hereby created in the
17State Treasury. Moneys in the fund shall be available, upon
18appropriation by the Legislature, to the State Department of
19Developmental Services to be used to supplement, and not
20supplant, existing purchase-of-service funds used by regional
21centers to purchase services and supports for persons with
22developmental disabilities.

23(b) For the purposes of this section, “net savings” means the
24operating budget of the applicable developmental center in the
252015-16 fiscal year, including all staff and indirect operating costs,
26less the costs needed to maintain the condition of the property after
27all residents have moved out.
