          SUMMARY:  This is the Developmental Services Trailer Bill for  
          2015-16.  It contains necessary changes related to the Budget  
          Act of 2015.  This bill makes various statutory changes to  
          implement the 2015-16 Budget.  Specifically, this bill:


          1)Specifies criterion that must be met in order for the  
            Department of Developmental Services to move forward with a  
            closure plan for a developmental center including provisions  
            related to consumer protection and stakeholder involvement. 
          2)Clarifies the Legislature's intent to utilize General Fund  
            savings from the developmental center closures to provide  
            enhancements for services in the community.

          3)Makes clarifications to the Self-Determination program to  
            ensure that residents transitioning out of developmental  
            centers have access to this program, and allows the Department  
            of Finance to increase the number of participants in this  
            program with approval from the Joint Legislative Budget  
            Committee. 


          4) Requires the Department of Developmental Services and  
            regional centers to provide a written copy of a client's  
            Individual Program Plan in a threshold language within 45  
            days, and a non-threshold language within 60 days.  


          5)Clarifies regional center's responsibility when regional  
            center clients are placed in an Institution for Mental Disease  
            (IMD), and requires the IMD to make a reasonable effort to  
            notify a regional center if it is determined that a regional  
            center client has been admitted.  


          6)Allows for the expansion of beds at the Porterville  
            Developmental Center, and prohibits the placement of an  
            individual in the transitional treatment unit for longer than  
            necessary to procure a less restrictive placement for the  
            client.  


          7)Caps the total amount of beds for the Delayed Egress and  
            Secured Perimeter facilities to 150 and requires a minimum of  
            50 beds be reserved for the Incompetent to Stand Trial  
            population. 


          8)Authorizes the development of up to 20 acres at the Fairview  
            Developmental Center to be used affordable housing for the  
            developmentally disabled.

          9)Makes adjustments to the provider rate structure for purposes  
            of implementing the requirement to provide paid sick leave for  
            employees.  


          10)Removes the cap on the amount of Enhanced Behavioral Supports  
            Homes that may be developed by the Department of Developmental  
            Services for the duration of the pilot project.  


          11)Requires the Department of Developmental Services to report  
            back on the impact of the federal Fair labor Standards Act on  
            developmentally disabled consumers.


          12)Includes an appropriation to fund prior year shortfall from  
            Budget Act of 2011 (SB 87 (Leno), Chapter 33, Statutes of  
            2011) and the Budget Act of 2012 (AB 1464 (Blumenfield),  
            Chapter 21, Statues of 2012 and AB 1497 (Budget Committee),  
            Chapter 29, Statutes of 2012).


          COMMENT:  This bill is a budget trailer bill within the overall  
          2015-16 budget package to implement actions taken affecting the  
          Department of Developmental Services.
