Senate Concurrent Resolution No. 90—Relative to Senate Rule 56 of the Standing Rules of the Senate for the 2015–16 Regular Session.

This measure would amend Senate Rule 56 of the Standing Rules of the Senate for the 2015-16 Regular Session by requiring a Member of the Assembly who establishes a campaign contribution account for the purpose of promoting his or her candidacy for State Senate to comply with contribution restriction periods applicable to Members of the Senate.

32015-16 Regular Session be amended as follows:


4That Rule 56 is amended to read:


6Contribution Restriction Periods


856.   (a) A Member of the Senatebegin insert, and a Member of the Assembly
9who establishes a campaign contribution account pursuant to
10Section 85201 of the Government Code for the purpose of
11promoting his or her candidacy for State Senate,end insert
shall not solicit
12or accept a contribution from a lobbyist employer during any of
13the following periods:

P2    1(1) In each year, the period from the date on which the Director
2of Finance provides to the Legislature a revised estimate of General
3Fund revenues, proposals to reduce expenditures based on that
4revision, and proposed adjustments to the Governor’s Budget
5pursuant to subdivision (e) of Section 13308 of the Government
6Code to the date of enactment of a Budget Bill for the fiscal year
7commencing on July 1 of the same year, inclusive.

8(2) In each odd-numbered year, the period from the date 30 days
9preceding the date the Legislature is scheduled to adjourn for a
10joint recess to reconvene in the second calendar year of the
11biennium of the legislative session to the date that adjournment
12occurs, inclusive.

13(3) In each even-numbered year, the period from August 1 to
14August 31, inclusive.

15(b) The Senate may take any disciplinary action it deems
16appropriate against a Member who violates subdivision (a),
17including, but not limited to, reprimand, censure, suspension, or
18expulsion.

19(c) For purposes of this rule, “contribution” and “lobbyist
20employer” have the same meanings as set forth in the Political
21Reform Act of 1974 (Title 9 (commencing with Section 81000)
22of the Government Code).
