An act to amend Section 14839 of the Government Code, relating to state government.

SB 159, as introduced, Nielsen. Office of Small Business and Disabled Veteran Business Enterprise Services.

Existing law provides for various programs to encourage the participation of small businesses, as certified by the Department of General Services, in state agency contracts, and sets forth the duties of the Office of Small Business and Disabled Veteran Business Enterprise Services in this regard.

This bill would make nonsubstantive changes to that provision.

The people of the State of California do enact as follows:

SECTION 1.  

Section 14839 of the Government Code is
2amended to read:

14839.  

There is hereby established within the department the
4Office of Small Business and Disabled Veteran Business Enterprise
5Services. The duties of the office shall include:

6(a) Compiling and maintaining a comprehensive bidders list of
7qualified small businesses and disabled veteran business
8enterprises, and noting which small businesses also qualify as
9microbusinesses.

P2    1(b) Coordinating with the Federal Small Business
2Administration, the Minority Business Development Agency, and
3the Office of Small Business Development of the Department of
4Economic and Business Development.

5(c) Providing technical and managerial aids to small businesses,
6microbusinesses, and disabled veteran businessbegin delete enterprises,end delete
7begin insert enterprisesend insert by conducting workshops on matters in connection
8with government procurement and contracting.

9(d) Assisting small businesses, microbusinesses, and disabled
10veteran businessbegin delete enterprises,end deletebegin insert enterprisesend insert in complying with the
11procedures for bidding on state contracts.

12(e) Working with appropriate state, federal, local, and private
13organizations and business enterprises in disseminating information
14on bidding procedures and opportunities available to small
15businesses, microbusinesses, and disabled veteran business
16enterprises.

17(f) Making recommendations to the department and other state
18agencies for simplification of specifications and terms in order to
19increase the opportunities for small business, microbusiness, and
20disabled veteran business enterprise participation.

21(g) Developing, by regulation, other programs and practices
22that are reasonably necessary to aid and protect the interest of small
23businesses, microbusinesses, and disabled veteran business
24enterprises in contracting with the state.

25(h) Making efforts to develop, in cooperation with associations
26representing counties, cities, and special districts, a core statewide
27small business certification application that may be adopted by all
28participating entities, with any supplemental provisions to be added
29as necessary by the respective entities.

30(i) The information furnished by each contractor requesting a
31small business or microbusiness preference shall be under penalty
32of perjury.
