The people of the State of California do enact as follows:
(a) The Legislature finds and declares all of the
2following:
3(1) Career training for adults is an important part of workforce
4and economic development in California.
5(2) Many of California’s neediest adult students require
6financial aid to support their career training.
7(3) Historically, those neediest adult students have had access
8to federal financial aid under Title IV of the federal
Elementary
9and Secondary Education Act (20 U.S.C. Sec. 6301 et seq.).
10(4) Recent revisions in federal regulations governing Title IV
11of the federal Elementary and Secondary Education Act (20 U.S.C.
12Sec. 6301 et seq.) have eliminated the eligibility for financial aid
13for adult students in many of California’s career training programs
P3 1operated by local educational agencies, even though adults in
2those programs have been historically eligible.
3(b) The Legislature therefore supports all of the following:

4(1) Adult students’ access to career training programs that will
5improve or expand their job skills and employability.
6(2) Adult students’ access to federal financial aid that may be
7used for career training programs and services.
8(3) Providers of career training programs for adult students,
9as those providers work to satisfy federal requirements necessary
10to establish federal financial aid eligibility for those adult students.

(a) The Superintendent may certify, by name, any
14regional occupational center or program, county office of
15education, or adult education program, that provides a program
16of training to prepare adult students for gainful employment in a
17recognized occupation, upon the center, program, or office’s
18satisfaction of the requirements in subdivision (b), to legally
19authorize the center, program, or office to provide an educational
20program beyond secondary education, including an education
21program that leads to a degree or certificate, for purposes of the
22center, program, or office participating in any student financial
23assistance program authorized by Title IV of the Higher Education
24Act of 1965, as amended (20 U.S.C. Sec. 1070 et seq.).
25(b) A
regional occupational center or program, county office
26of education, or adult education program applying for certification
27pursuant to subdivision (a) shall comply with both of the following:
28(1) Satisfying all applicable eligibility requirements specified
29in federal rulemaking pursuant to Sections 600.6, 600.7, and 600.9
30of Title 34 of the Code of Federal Regulations, other than the
31authorization provided for in subdivision (a).
32(2) Applying in writing to the Superintendent, as an individual
33center, program, or office, to be considered for certification
34pursuant to subdivision (a).
35(c) Any person may file a complaint under the Uniform
36Complaint Procedures, as set forth in Title 5 of the California
37Code of Regulations, regarding an alleged violation by a local
38agency of federal or state law or regulations governing
adult
39education programs or regional occupational centers and
P4 1programs, including allegations of unlawful discrimination,
2harassment, intimidation, or bullying.
3(d) The Superintendent shall adopt regulations that authorize
4any person to file a complaint under the Uniform Complaint
5Procedures, as set forth in Title 5 of the California Code of
6Regulations, regarding an alleged violation by a county office of
7education of federal or state law or regulations governing that
8county office of education’s participation in any student financial
9assistance program authorized by Title IV of the Higher Education
10Act of 1965, as amended (20 U.S.C. Sec. 1070 et seq.), including
11allegations of unlawful discrimination, harassment, intimidation,
12or bullying.
13(e) The Superintendent may decertify, for purposes of
14participating in any student financial assistance program
15authorized by Title IV of the
Higher Education Act of 1965, as
16amended (20 U.S.C. Sec. 1070 et seq.), a regional occupational
17center or program, county office of education, or adult education
18program previously certified in accordance with subdivision (a)
19if the Superintendent determines that the regional occupational
20center or program, county office of education, or adult education
21program is no longer in compliance with the requirements outlined
22in subdivision (b).
This act is an urgency statute necessary for the
24immediate preservation of the public peace, health, or safety within
25the meaning of Article IV of the Constitution and shall go into
26immediate effect. The facts constituting the necessity are:
27In order for regional occupational centers and programs, county
28offices of education, adult schools, and evening high schools to
29satisfy federal requirements in order to participate in federal
30student aid programs, it is necessary for this act to take effect
31immediately.
Section 52300 of the Education Code is amended
33to read:
(a) (1) In enacting this article, it is the intent of the
35Legislature to provide qualified pupils with the opportunity to
36attend a technical school or enroll in a career technical or technical
37training program, regardless of the geographical location of their
38residence in a county or region.
39(2) The
Legislature hereby declares that a regional occupational
40center and program or a county office of education will serve the
P5 1state and national interests in providing secondary and
2postsecondary programs focused on career technical and technical
3education to prepare pupils for an increasingly technological
4society in which generalized training and skills are insufficient to
5prepare high school pupils and graduates, and out-of-school youth
6and adults for the many employment opportunities that require
7special or technical training and skills.
8(3) The Legislature also declares that regional occupational
9centers and programs or county offices of education will enable a
10broader curriculum in technical subjects to be offered, and will
11avoid unnecessary duplication of courses and expensive training
12equipment, and will provide a flexibility in operation that will
13facilitate rapid program adjustments and meeting changing training
14needs as they arise.
15(b) It is recognized by the Legislature that career technical
16
programs may achieve great flexibility of planning, scope, and
17operation by the conduct of these programs in a variety of physical
18facilities at various training locations.
19(c) It is the further intent of the Legislature that regional
20occupational centers and programs or county offices of education
21provide career technical and occupational instruction related to
22the attainment of skills so that trainees are prepared for gainful
23employment in the area for which training was provided, or are
24upgraded so they have the higher level skills required because of
25new and
changing technologies or so that they are prepared for
26enrollment in more advanced training programs.
27(d) The Legislature further recognizes that, for purposes of
28participation in any student financial assistance program authorized
29by Title IV of the federal Higher Education Act of 1965, as
30amended (20 U.S.C. Sec. 1070 et seq.), the Superintendent may
31certify, by name, a regional occupational center and program or a
32county office of education.
Section 52500 of the Education Code is amended to
34read:
(a) Adult schools and evening high schools shall consist
36of classes for adults, and may include postsecondary career
37technical education programs. Minors may be admitted to those
38classes pursuant to board policy and Section 52500.1.
39(b) For purposes of participation in any student financial
40assistance program
authorized by Title IV of the federal Higher
P6 1Education Act of 1965, as amended (20 U.S.C. Sec. 1070 et seq.),
2the Superintendent may certify, by name, an adult school or an
3evening high school.
This act is an urgency statute necessary for the
