BILL ANALYSIS Ó SB 436 Page 1 Date of Hearing: July 15, 2015 ASSEMBLY COMMITTEE ON EDUCATION Patrick O'Donnell, Chair SB 436 (Committee on Education) - As Amended July 8, 2015 SENATE VOTE: 37-0 SUBJECT: Education: omnibus bill. SUMMARY: Makes technical and non-controversial revisions to the Education Code. Specifically, this bill: 1)Corrects references to non-existent code sections and makes technical changes to provisions related to school district reorganization. (Sections 1, 2, 4, 5, 6, 7, 15, 16, 17) 2)Clarifies that the three schoolsite representatives of the K-12 High Speed Network advisory board serve a renewable two-year term, consistent with the terms of the other advisory board members. (Section 3) 3)Removes obsolete references regarding the State School Deferred Maintenance Program, whose funding was removed with the establishment of the Local Control Funding Formula. (Sections 8, 9, 10, 11, 12, 13, 14) SB 436 Page 2 4)Eliminates various reporting requirements and program evaluations that no longer exist, including reporting requirements for the following programs: a) Compton Unified School District extended year program. b) Bilingual education programs. c) State Bilingual Teacher Training Assistance Program. d) Programs funded using Economic Impact Aid. (Sections 18, 19, 21, 22, 23) 5)Corrects a drafting error in AB 1584 (Buchanan), Chapter 800, Statutes of 2014, by inserting a comma that was left out in Education Code Section 49073.1(d)(5)(B)(i), after "educational products." (Section 20) 6)Replaces outdated references to the Standardized Testing and Reporting Program with the California Assessment of Student Performance and Progress System of assessments. (Sections 26 and 29) 7)Corrects code section references in provisions related to services for individuals with exceptional needs. (Sections 24, 25, 26. 27, 28) SB 436 Page 3 EXISTING LAW assigns various duties to state and local educational agencies and governs the operation of public schools. FISCAL EFFECT: According to the Senate Appropriations Committee, pursuant to Senate Rule 28.8, negligible state costs. COMMENTS: This bill is the annual K-12 education clean-up bill that makes various non-controversial revisions to the Education Code. The majority of the provisions were identified by the California Department of Education and make technical corrections to the statute, such as correcting a section citation or striking obsolete language. By tradition, objection to any provision by the agency affected, the Department of Finance, or any of the four legislative caucuses prevents that provision from being included in this bill.
