Existing law provides that the Department of Transportation has full possession and control of all state highways. Existing law describes the authorized routes in the state highway system and establishes a process for adoption of a highway on an authorized route by the California Transportation Commission. Existing law authorizes the commission to relinquish certain state highway segments to local agencies.

This bill would authorize the commission to relinquish the portion of State Highway Route 164 from Gallatin Road near Pico Rivera to the southern city limits of South El Monte in the vicinity of Rush Street in the County of Los Angeles to that county, under specified conditions.

Existing law, the California Toll Bridge Authority Act, makes the California Transportation Commission, together with the Department of Transportation, responsible for building and acquiring toll facilities and related transportation facilities. Under existing law, all tolls or other revenue received from the operation of toll bridges and related facilities that were acquired or constructed with bond funding are deposited into a special fund designated for the particular toll bridge or facility that produced the toll or revenue.

This bill would make nonsubstantive changes to the provision specifying deposit of this particular revenue into the designated special fund.

11(b) The relinquished former portions of Route 164 within the
12County of Los Angeles and the City of Temple City are not state
13highways and are not eligible for adoption under Section 81. For
14the relinquished former portions of Route 164, the County of Los
15Angeles and the City of Temple City shall maintain within their
16respective jurisdictions signs directing motorists to the continuation
17of Route 164.

18(c) (1) Notwithstanding subdivision (a), the commission may
19relinquish to the County of Los Angeles that portion of Route 164
20described in paragraph (1) of subdivision (a), pursuant to the
21terms of a cooperative agreement between the county and the
22department, upon a determination by the commission that the
23relinquishment is in the best interests of the state.

24(2) A relinquishment under this subdivision shall become
25effective immediately following the recordation by the county
26recorder of the relinquishment resolution containing the
27commission’s approval of the terms and conditions of the
28relinquishment.

29(3) On and after the effective date of the relinquishment, both
30of the following shall apply:

31(A) The portion of Route 164 relinquished under this subdivision
32shall cease to be a state highway.

2may not be considered for future adoption under Section 81.

3(4) For the portion of Route 164 that is relinquished under this
4subdivision, the County of Los Angeles shall maintain within its
5jurisdiction signs directing motorists to the continuation of Route
6164.

SECTION 1.  

Section 30304 of the Streets and Highways Code
8 is amended to read:

30304.  

All tolls or other revenues received from the operation
10of any toll bridge or other highway crossing, transportation
11facilities, or additional transportation facilities acquired or
12constructed with the proceeds of bonds issued and sold pursuant
13to this chapter shall be paid by the department at least monthly to
14the State Treasurer who shall deposit them forthwith in a depositary
15or depositaries authorized by law to receive deposits of state funds,
16to the credit of a special fund to be designated as the toll revenue
17fund of the particular toll bridge or other highway crossing,
18transportation facilities, or additional transportation facilities
19producing the tolls or revenue. The fund shall at all times be kept
20segregated and set apart from all other funds.
