An act to amend Section 464 of the Streets and Highways Code, relating to highways.

SB 461, as amended, Hernandez. State Highway Route 164: relinquishment.

Existing law provides that the Department of Transportation has full possession and control of all state highways. Existing law describes the authorized routes in the state highway system and establishes a process for adoption of a highway on an authorized route by the California Transportation Commission. Existing law authorizes the commission to relinquish certain state highway segments to local agencies.

This bill would authorize the commission to relinquish the portion of State Highway Route 164 from Gallatin Road near Pico Rivera to the southern citybegin delete limitsend deletebegin insert limitend insert ofbegin delete Southend delete El Monte in the vicinity ofbegin delete Rush Streetend deletebegin insert the Rio Hondo Riverend insert in the County of Los Angeles to that county, under specified conditions.

The people of the State of California do enact as follows:

SECTION 1.  

Section 464 of the Streets and Highways Code
2 is amended to read:

(a) Route 164 is Rosemead Boulevard from:

2(1) Gallatin Road near Pico Rivera to the southern city limit of
3begin delete Southend delete El Monte in the vicinity ofbegin delete Rush Street.end deletebegin insert the Rio Hondo River.end insert

4(2) The southern city limit ofbegin delete Southend delete El Monte in the vicinity of
5begin delete Rush Streetend deletebegin insert the Rio Hondo Riverend insert to the southern city limit of
6Temple City in the vicinity of Grand Avenue.

7(3) Route 210 to Foothill Boulevard in the City of Pasadena.

8(b) The relinquished former portions of Route 164 within the
9County of Los Angeles and the City of Temple City are not state
10highways and are not eligible for adoption under Section 81. For
11the relinquished former portions of Route 164, the County of Los
12Angeles and the City of Temple City shall maintain within their
13respective jurisdictions signs directing motorists to the continuation
14of Route 164.

15(c) (1) Notwithstanding subdivision (a), the commission may
16relinquish to the County of Los Angeles that portion of Route 164
17described in paragraph (1) of subdivision (a), pursuant to the terms
18of a cooperative agreement between the county and the department,
19upon a determination by the commission that the relinquishment
20is in the best interests of the state.

21(2) A relinquishment under this subdivision shall become
22effective immediately following the recordation by the county
23recorder of the relinquishment resolution containing the
24commission’s approval of the terms and conditions of the
25relinquishment.

26(3) On and after the effective date of the relinquishment, both
27of the following shall apply:

28(A) The portion of Route 164 relinquished under this subdivision
29shall cease to be a state highway.

30(B) The portion of Route 164 relinquished under this subdivision
31may not be considered for future adoption under Section 81.

32(4) For the portion of Route 164 that is relinquished under this
33subdivision, the County of Los Angeles shall maintain within its
34jurisdiction signs directing motorists to the continuation of Route
35164.
