Bill
Summary: This bill: (1) requires school districts to provide
educational programs that promote healthy relationships and
prevent adolescent relationship abuse to students in grades 6
through 12; (2) requires the Superintendent of Public
Instruction to provide information for use by schools; and (3)
requires school safety plans to include procedures and policies
to prevent and respond to adolescent relationship abuse.
Fiscal
Impact:
Mandate: This bill could result in a reimbursable state
mandate for school districts to provide educational programs
to students in grades 6 through 12 estimated to be in the low
millions in Proposition 98 General Fund. School districts are
estimated to incur additional costs for related curriculum
materials of about $1.5 million in the first year and $1
million in subsequent years, and professional development

costs of $1.6 million initially, and lesser ongoing costs.
CDE administrative costs: CDE indicates that this bill results
in costs to the department of about $300,000 General Fund in
the first year and $122,000 General Fund in the second year to
provide guidance and other related material.
Cost pressure: The requirement, contingent upon funding in the
budget, for CDE and the Department of Justice to contract with
trainers to coordinate statewide workshops creates a cost
pressure to do so.
Background: Current law requires each school district and county office of
education to be responsible for the overall development of all
comprehensive school safety plans for its schools. Current law
defines a safety plan to mean a plan to develop strategies aimed
at the prevention of, and education about, potential incidents
involving crime and violence on the school campus. Schoolsite
councils are required to write and develop a comprehensive
school safety plan relevant to the needs and resources of that
particular school. Schoolsite councils are authorized to
delegate this responsibility to a school safety planning
committee. (Education Code § 32281)
Current law also requires school safety plans to include
identification of appropriate strategies and programs that will
provide a high level of school safety and address the school's
procedures for complying with existing laws related to school
safety, including the development of numerous plans and
procedures. (Education Code § 32282)
Current law requires the Instructional Quality Commission,
during the next revision of the health curricular framework, to
consider including content that includes healthy boundaries for
relationships, how to recognize potentially harmful and abusive
relationships, and refusal skills to overcome peer pressure and
to avoid high-risk activities. (Education Code § 33545)
Proposed Law:
This bill:
Requires school districts, beginning in July 2016, to provide
educational programs to promote healthy relationships and

prevent adolescent relationship abuse to pupils in grades 6 to
12 through curriculum, extracurricular activities, or school
climate-improvement activities. In providing these programs,
this bill requires a school district to use research-based
materials that are appropriate for pupils of all races,
genders, sexual orientations, gender identities, and cultural
backgrounds, and for pupils with disabilities.
Requires CDE to provide information, as specified, on related
policies and curriculum as well as guidelines on how to
appropriately use the curriculum on the department's website.
Requires school safety plans to include procedures and
policies to prevent and respond to adolescent relationship
abuse in middle and high schools serving pupils in grades 6 to
12 in collaboration with organizations with expertise in this
subject.
Requires, contingent upon funded provided in the Budget Act,
the Department of Justice and the State Department of
Education to contract with professional trainers to coordinate
statewide workshops for school districts, county offices of
education, and schoolsite personnel to provide training in the
prevention of adolescent relationship abuse.
Related
Legislation:
SB 695 (De Leon), pending in this committee, requires school
districts that require a course in health education for high
school graduation to include instruction in sexual assault and
violence in that course and for the Instructional Quality
Commission to make revisions, as specified, during the next
revision of the health framework.
AB 1857 (Fong, 2012), AB 1880 (Lara, 2012), and AB 1373 (Fong,
2011), all similar to this bill, were held in the Assembly
Appropriations Committee.
