An act to add Section 5055.5 to the Penal Code, relating to prisons.

SB 601, as introduced, Hancock. Corrections: prisons: accountability report.

Existing law provides that the supervision, management, and control of the state prisons, and the responsibility for the care, custody, treatment, training, discipline, and employment of persons confined therein are vested in the Secretary of the Department of Corrections and Rehabilitation.

This bill would require the Secretary of the Department of Corrections and Rehabilitation to develop a Corrections Accountability Report on January 10, March 15, and a fiscal year-end report, containing specified information regarding each institution, including, among other information, the total budget, including actual expenditures, staff vacancies and the number of authorized staff positions, overtime, sick leave, and the average length of lockdowns, and to post those reports on the department’s Internet Web site, as provided.

SECTION 1.  

Section 5055.5 is added to the Penal Code, to

5055.5.  

(a) The Secretary of the Department of Corrections
4and Rehabilitation shall develop a Corrections Accountability
P2    1Report as described in subdivisions (b) and (c) for each institution
2on January 10, March 15, and a fiscal year-end report and post
3those reports on the department’s Internet Web site. The department
4shall post both current fiscal-year reports and reports for the
5immediately preceding three fiscal years for each institution. The
6department shall also post corrections made to inaccurate or
7incomplete data to current or previous reports.

8(b) Each report shall include the three-year statewide recidivism
9rate, a brief biography of the warden, including whether he or she
10is an acting or permanent warden, contact information for the
11warden, and a brief description of the prison, including the total
12number of inmates.

13(c) Each report shall be created using, when possible,
14information collected using the Compstat (computer assisted
15statistics) reports for each prison, or other verifiable information
16collected by the department, and shall include, but not be limited
17to, all of the following indicators:

18(1) Total budget, including actual expenditures, staff vacancies,
19overtime, sick leave, and number of authorized staff positions.

20(2) Rehabilitation programs, including capacity, enrollment,
21and diploma and GED completion rate.

22(3) Average length of lockdowns.

23(4) Number of deaths, specifying homicides, suicides,
24unexpected deaths, and expected deaths.

25(5) Number of use of force incidents.

26(6) Number of inmate appeals, including the number being
27processed, overdue, and dismissed.

28(7) Number of inmates in administrative segregation.

29(8) Total contraband seized, specifying the number of cellular
30telephones.
