SB 871, as amended, Liu. California Collaborative for Educational Excellence: professional development training: pilot program.
Existing law, on or before July 1, 2014, requires the governing board of each school district and each county board of education to adopt a local control and accountability plan and requires the governing board of each school district and each county board of education to update its local control and accountability plan on or before July 1 of each year. Existing law requires the local control and accountability plan to include certain elements, and requires the charter for a charter school to include some of those same elements. Existing law requires the State Board of Education, on or before October 1, 2016, to adopt evaluation rubrics to, among other things, assist a school district, county office of education, or charter school in evaluating its strengths, weaknesses, and areas that require improvement. Existing law establishes the California Collaborative for Educational Excellence for purposes of advising and assisting school districts, county superintendents of schools, and charter schools in achieving the goals set forth in a local control and accountability plan.
This bill would require the collaborative, commencing with the 2016-17 fiscal year, to establish a statewide infrastructure to provide professional development training to school districts, county offices of education, and charter schools for the purpose of successfullybegin delete implementingend deletebegin insert utilizingend insert the evaluation rubrics adopted by the state board. The bill would require the professional development training to include, among other things, informationbegin delete ofend deletebegin insert
onend insert how the evaluation rubrics are used for the development and implementation of the local control and accountability plans and those similar elements in charter petitions, and information on how the evaluation rubrics will be used, in conjunction with local control and accountability plans, to establish a system of continuous improvement. The bill would require the collaborative to ensure that the professional development training is provided in each region of the state and is available to all school districts, county offices of education, and charter schools.begin insert The bill would require the collaborative to submit an implementation plan to the relevant policy and fiscal committees of the Legislature, the Director of Finance, and the Legislative Analyst’s Office within 30 days of the state board’s adoption of the evaluation rubrics, as specified.end insert The bill also would require
the collaborative, during the 2017-18 fiscal year, to conduct a survey of school districts, county offices of education, and charter schools on how they used the evaluation rubrics.

the governing board of the collaborative to submit to the relevant policy and fiscal committees of the Legislature, the Director of Finance, and the Legislative Analyst’s Office, an implementation planbegin delete byend deletebegin insert for the pilot programend insert on or before August 15, 2016, as specified, and a report about lessons learned from the pilot program and its implications for the ongoing work of the collaborativebegin delete byend delete on or before November 1, 2018.
The bill would make the implementation of its provisions contingent upon funds being appropriated for its purposes in the annual Budget Act or another enacted statute.

The people of the State of California do enact as follows:
Section 52074.5 is added to the Education Code,
2to read:
(a) Commencing with the 2016-17 fiscal year, the
4California Collaborative for Educational Excellence shall establish
5a statewide infrastructure to provide professional development
6training to school districts, county offices of education, and charter
7schools for the purpose of successfullybegin delete implementingend deletebegin insert utilizingend insert the
8evaluation rubrics adopted by the state board pursuant to Section
952064.5.
10(b) The professional development training shall include, but
11shall not be limited to, all of the following:
12(1) Informationbegin delete ofend deletebegin insert onend insert how the evaluation rubrics are used for
13the development and implementation of the local control and
14accountability plans required pursuant to Sections 52060 and
1552066, and the requirements of subparagraph (A) of paragraph (5)
16of subdivision (b) of Section 47605 and subparagraph (A) of
17paragraph (5) of subdivision (b) of Section 47605.6.
18(2) Information on how the evaluation rubrics will be used to
19begin delete increase academic achievement,end deletebegin insert improve pupil outcomes,end insert with
20emphasis on closing the achievement gap for unduplicated pupils,
21as defined in
Section 42238.02, and the pupil subgroups identified
22in Section 52052.
23(3) The role of statewide and local data in using the evaluation
24rubrics to inform the development of local control and
25accountability plans and to communicate with stakeholders.
26(4) Information on how the evaluation rubrics will be used, in
27conjunction with local control and accountability plans, to establish
28a system of continuous improvement, as identified in subdivision
29(c) of Section 52064.5.
30(c) The California Collaborative for Educational Excellence
31shall ensure that the professional development training is provided
32in each region of the state and available to all school districts,
33county offices of education, and charter schools. The California
34Collaborative for Educational Excellence may contract with one
35or more entities to provide the
professional development training.

37shall submit an implementation plan to the relevant policy and
38fiscal committees of the Legislature, the Director of Finance, and

2begin insert within 30 days of the state board’s adoption of the evaluation
3rubrics.end insert The plan shall include relevant expenditure and provider
4information, and a timeline to commence training by no later than
5Octoberbegin delete 1,end deletebegin insert
15,end insert 2016.
6(2) The implementation plan shall also include information on
7how the California Collaborative for Educational Excellence will
8determine the appropriate sequence of which local educational
9agencies will receive the professional development training.
10(e) During the 2017-18 fiscal year, the California Collaborative
11for Educational Excellence shall conduct a survey of school
12districts, county offices of education, and charter schools on how
13they used the evaluation rubrics to develop and implement their
14most recent local control and accountability plan, or meet the
15requirements of subparagraph (A) of paragraph (5) of subdivision
16(b) of Section 47605 or subparagraph (A) of paragraph (5) of
17subdivision (b) of Section 47605.6, as
applicable.
18(f) This section shall not be implemented unless funding is
19provided for its purposes in the annual Budget Act or another
20enacted statute.
Section 52074.6 is added to the Education Code, to
22read:
(a) (1) During the 2016-17 and 2017-18 fiscal years,
24the California Collaborative for Educational Excellence shall
25implement a pilot program that will inform its long-term efforts
26to advise and assist school districts, county superintendents of
27schools, and charter schools in improving pupilbegin delete achievementend delete
28begin insert outcomesend insert pursuant to Section 52074.
29(2) It is the intent of the Legislature that this pilot program be
30used to advise the governing board of the California Collaborative
31for Educational Excellence in their efforts to provide research
32
based, quality advice and assistance to local educational agencies.
33Nothing in this section prohibits the California Collaborative for
34Educational Excellence from continuing to meet the requirements
35of Section 52074 in the 2016-17 fiscal year or in future fiscal
36years.
37(b) On or before August 15, 2016, the governing board of the
38California Collaborative for Educational Excellence shall submit
39a plan for implementing the pilot program to the relevant policy
40and fiscal committees of the Legislature, the Director of Finance,
P5 1and the Legislative Analyst’s Office. At a minimum, the plan shall
2describe all of the following:
3(1) The goals of the pilot program, including, but not limited
4to, improving pupil outcomes related to the state priorities
5identified in Sections 52060 and 52066.
6(2) The major implementation
activities of the pilot program
7and the means for assessing whether the goals are met.
8(3) An implementation timeline and a program budget, with
9anticipated expenditures and funding sources.
10(c) (1) The Superintendent shall assign the California
11Collaborative for Educational Excellence to assist school districts,
12county offices of education, and charter schools in the pilot
13program. In making those assignments, the Superintendent shall
14consider input from the collaborative and any requests from school
15districts, county superintendents of schools, or charter schools to
16participate in the pilot program.
17(2) To the extent possible, the pilot program shall include school
18districts, county offices of education, and charter schools from
19urban, suburban, and rural areas representing all regions of the
20
state, as well as those with enrollment of unduplicated pupils, as
21defined in Section 42238.02, and the pupil subgroups identified
22in Section 52052.
23(3) Participation by a local educational agency in the pilot
24program is voluntary and, notwithstanding Sections 52071 and
2552071.5, participating local educational agencies shall not pay for
26any assistance provided pursuant to the pilot program.
27(d) On or before November 1, 2018, the governing board of the
28California Collaborative for Educational Excellence shall report
29to the relevant policy and fiscal committees of the Legislature, the
30begin delete Departmentend deletebegin insert Directorend insert of Finance, and the Legislative Analyst’s
31Office about lessons learned from the pilot
program and its
32implications for the ongoing work of the California Collaborative
33for Educational Excellence.
34(e) This section shall not be implemented unless funding is
35provided for its purposes in the annual Budget Act or another
36enacted statute.
