SUMMARY:
This bill requires the High-Speed Rail Authority (Authority),
prior to selling surplus property, to notify by certified mail
the last known owner of the property and to not sell the
property until at least 30 days following the notification.

FISCAL EFFECT:
Minor absorbable costs for the Authority to provide the required
notifications in a timely manner.
COMMENTS:
Purpose. AB 481 (Lowenthal), Chapter 132, Statutes of 2013,
allows the Authority to dispose of properties that it deems no
longer necessary, but does not provide the original landowner
the right to be notified that the property will be sold. SB 940
does not require a first right of refusal for the previous
owner, but does, at least, provide notification that a property
will be sold, thereby improving the opportunity for the previous
owner to purchase the property.
