An act to amend Sections 21453 and 42001.15 of the Vehicle Code, relating to vehicles.

SB 986, as amended, Hill. Vehicles: right turn violations.

Existing law requires a driver facing a steady circular red signal alone to stop at a marked limit line, but if none, before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and to remain stopped until an indication to proceed is shown, except as specified. A violation of this provision is an infraction punishable by a fine of $100.

The people of the State of California do enact as follows:

SECTION 1.  

Section 21453 of the Vehicle Code is amended
2to read:

21453.  

(a) A driver facing a steady circular red signal alone
2shall stop at a marked limit line, but if none, before entering the
3crosswalk on the near side of the intersection or, if none, then
4before entering the intersection, and shall not proceed straight
5through the intersection, turn left, except from a one-way street
6onto a one-way street, or turn in a manner prohibited by a sign,
7until an indication to proceed is shown.

8(b) A driver facing a steady circular red signal alone shall, prior
9to turningbegin delete rightend deletebegin insert right,end insert or turning left from a one-way street onto a
10one-way street, stop at a marked limit line, but if none, before
11entering the crosswalk on the near side of the intersection or, if
12none, before entering the intersection.

13(c) A driver facing a steady red arrow signal shall not enter the
14intersection to make the movement indicated by the arrow and,
15unless entering the intersection to make a movement permitted by
16another signal, shall stop at a clearly marked limit line, but if none,
17before entering the crosswalk on the near side of the intersection,
18 or if none, then before entering the intersection, and shall remain
19stopped until an indication permitting movement is shown.

20(d) Unless otherwise directed by a pedestrian control signal as
21provided in Section 21456, a pedestrian facing a steady circular
22red or red arrow signal shall not enter the roadway.

23(e) A driver making a turn pursuant to subdivision (b) shall yield
24the right-of-way to pedestrians lawfully within an adjacent
25crosswalk and to any vehicle that has approached or is approaching
26so closely as to constitute an immediate hazard to the driver, and
27shall continue to yield the right-of-way to that vehicle until the
28driver can proceed with reasonable safety.

SEC. 2.  

Section 42001.15 of the Vehicle Code is amended to
30read:

42001.15.  

(a) Every person convicted of an infraction for a
32violation of subdivision (a) or (c) of Section 21453, subdivision
33(c) of Section 21454, or subdivision (a) of Section 21457 shall be
34punished by a fine of one hundred dollars ($100).

35(b) Every person convicted of an infraction for a violation of
36subdivision (b) of Section 21453 shall be punished by a fine of
37thirty-five dollars ($35).
