Existing law requires a driver facing a steady circular red signal alone to stop at a marked limit line, but if none, before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and to remain stopped until an indication to proceed is shown, except as specified. A violation of this provision is an infraction punishable by a fine of $100.

This bill would recast those provisions, and instead would make a violation of that requirement for a right turn, or a left turn from a one-way street onto a one-way street, punishable by a fine of $35.begin insert The bill would make additional conforming changes.end insert

SECTION 1.  

Section 21453 of the Vehicle Code is amended

21453.  

(a) A driver facing a steady circular red signal alone
4shall stop at a marked limit line, but if none, before entering the
5crosswalk on the near side of the intersection or, if none, then
6before entering the intersection, and shall not proceed straight
7through the intersection, turn left, except from a one-way street
8onto a one-way street, or turn in a manner prohibited by a sign,
9until an indication to proceed is shown.

10(b) A driver facing a steady circular red signal alone shall, prior
11to turning right, or turning left from a one-way street onto a
12one-way street, stop at a marked limit line, but if none, before
13entering the crosswalk on the near side of the intersection or, if
14none, before entering the intersection.

15(c) A driver facing a steady red arrow signal shall not enter the
16intersection to make the movement indicated by the arrow and,
17unless entering the intersection to make a movement permitted by
18another signal, shall stop at a clearly marked limit line, but if none,
19before entering the crosswalk on the near side of the intersection,
20 or if none, then before entering the intersection, and shall remain
21stopped until an indication permitting movement is shown.

22(d) Unless otherwise directed by a pedestrian control signal as
23provided in Section 21456, a pedestrian facing a steady circular
24red or red arrow signal shall not enter the roadway.

25(e) A driver making a turn pursuant to subdivision (b) shall yield
26the right-of-way to pedestrians lawfully within an adjacent
27crosswalk and to any vehicle that has approached or is approaching
28so closely as to constitute an immediate hazard to the driver, and
29shall continue to yield the right-of-way to that vehicle until the
30driver can proceed with reasonable safety.

Notwithstanding any other provision of law, any person
33who violates subdivision (a) or (b) of Section 21451, subdivision

36the driver is guilty of an infraction punishable under Section

Section 42001.15 of the Vehicle Code is amended to

(a) Every person convicted of an infraction for a
5violation of subdivision (a) or (c) of Section 21453, subdivision
6(c) of Section 21454, or subdivision (a) of Section 21457 shall be
7punished by a fine of one hundred dollars ($100).

8(b) Every person convicted of an infraction for a violation of
9subdivision (b)begin insert or (e)end insert of Section 21453 shall be punished by a fine
10of thirty-five dollars ($35).
