Notwithstanding Section 14670, the Director of
4General Services, with the consent of the State Department of State
5Hospitals, may, in the best interests of the state, let to a public
6governmental agency, for the purpose of locating and conducting
7itsbegin delete trainable mentally retarded program,end deletebegin insert special needs and
8alternative education programs,end insert
and for locating and conducting
9a child-care facility, and for a period not to exceed 50 years, real
10property not exceeding 10 acres located within the grounds of the
11Napa State Hospital. For the additional purpose of establishing an
12educational park, the director may, with the consent of the
13department, renegotiate the lease, for a period not to exceed 50
14years, which period shall commence January 1, 1993. For the
15purposes of this section, “educational park” means a conglomerate
16of educational services, including, but not limited to, a children’s
17center, a preschool for severely disabled children, adult educational
18services, administrative offices, a community school, and a media
19services building.begin insert The lease provided for in this section may be
20renewed for an additional period, not to exceed 50 years.end insert

21The lease authorized by this section shall be nonassignable and
22shall be subject to periodic review every five years. That review
23shall be made by the Director of General Services, who shall do
24both of the following:

25(a) Assure the state the purposes of the lease are being carried
26out.

27(b) Determine what, if any, adjustment should be made in the
28terms of the lease.

2building facility by the lessee prior to July 1, 1977. That facility
3shall not be established until after the effective date of the act

Section 14672.1 of the Government Code is amended
7to read:

14672.1.  

Notwithstanding Section 14670, the Director of

19A lease executed pursuant to this section may be assigned or

21public entity to any publicbegin insert governmentalend insert agency with the approval
22of the Director of General Services and the Department of
23Corrections and Rehabilitation.
