An act to amend Section 25302 of the Public Resources Code, relating to energy.

Existing law requires the State Energy Resources Conservation and Development Commission to prepare an integrated energy policy report every 2 years.

This bill would make nonsubstantive changes to that provision.

The people of the State of California do enact as follows:

SECTION 1.  

Section 25302 of the Public Resources Code is
2amended to read:

25302.  

(a) Beginning November 1, 2003, and every two years
4thereafter, the commission shall adopt an integrated energy policy
5report. This integrated report shall contain an overview of major
6energy trends and issues facing the state, including, but not limited
7to, supply, demand, pricing, reliability, efficiency, and impacts on
8public health and safety, the economy, resources, and the
9environment. Energy markets and systems shall be grouped and
10assessed in three subsidiary volumes:

11(1) Electricity and natural gas markets.

12(2) Transportation fuels, technologies, and infrastructure.

13(3) Public interest energy strategies.

P2    1(b) The commission shall compile the integrated energy policy
2report prepared pursuant to subdivision (a) by consolidating the
3analyses and findings of the subsidiary volumes in paragraphs (1),
4(2), and (3) of subdivision (a). The integrated energy policy report
5shall present policy recommendations based on an indepth and
6integrated analysis of the most current and pressing energy issues
7facing the state. The analyses supportingbegin delete thisend deletebegin insert theend insert integrated energy
8policy report shall explicitly address interfuel and intermarket
9effects to provide a more informed evaluation of potential tradeoffs
10when developing energy policy across different markets and
11systems.

12(c) The integrated energy policy report shall include an
13assessment and forecast of system reliability and the need for
14resource additions, efficiency, and conservation that considers all
15aspects of energy industries and markets that are essential for the
16state economy, general welfare, public health and safety, energy
17diversity, and protection of the environment. This assessment shall
18be based on determinations made pursuant to this chapter.

19(d) Beginning November 1, 2004, and every two years thereafter,
20the commission shall prepare an energy policy review to update
21analyses from the integrated energy policy report prepared pursuant
22to subdivisions (a), (b), and (c), or to raise energy issues that have
23emerged since the release of the integrated energy policy report.
24The commission may also periodically prepare and release
25technical analyses and assessments of energy issues and concerns
26to provide timely and relevant information for the Governor, the
27 Legislature, market participants, and the public.

28(e) In preparation of thebegin insert integrated energy policyend insert report, the
29commission shall consult with the following entities: the Public
30Utilities Commission, the Office of Ratepayer Advocates, the State
31Air Resources Board,begin delete the Electricity Oversight Board,end delete the
32Independent System Operator, the Department of Water Resources,
33begin delete the California Consumer Power and Conservation Financing
34Authority,end delete
the Department of Transportation, and the Department
35of Motor Vehicles, and any federal, state, and local agencies it
36deems necessary in preparation of thebegin delete integrated energy policyend delete
37 report. Tobegin delete assureend deletebegin insert ensureend insert collaborative development of state energy
38policies, these agencies shall make a good faith effort to provide
39data, assessment, and proposed recommendations for review by
40the commission.

P3    1(f) The commission shall provide the report to the Public
2Utilities Commission, the Office of Ratepayer Advocates, the State
3Air Resources Board,begin delete the Electricity Oversight Board,end delete the
4Independent System Operator, the Department of Water Resources,
5begin delete the California Consumer Power and Conservation Financing
6Authority,end delete
and the Department of Transportation. For the purpose
7of ensuring consistency in the underlying information that forms
8the foundation of energy policies and decisions affecting the state,
9those entities shall carry out their energy-related duties and
10responsibilities based upon the information and analyses contained
11in the report. If an entity listed in this subdivision objects to
12information contained in the report, and has a reasonable basis for
13that objection, the entity shall not be required to consider that
14information in carrying out its energy-related duties.

15(g) The commission shall make the report accessible to state,
16local, and federal entities and to the general public.
