An act to repeal Section 49550.2 of, to repeal Article 5 (commencing with Section 49350) of Chapter 8 of Part 27 of, to repeal Article 2 (commencing with Section 51120) and Article 4 (commencing with Section 51140) of Chapter 1.5 of, and to repeal Article 6.5 (commencing with Section 51755) of Chapter 5 of Part 28 of, Division 4 of Title 2 of, the Education Code, relating to educational programs.

Existing law required the Legislature to complete a specified study on or before March 31, 2007, on specified matters relating to school breakfast programs. Existing law establishes the Community Policing and Mentoring for School Safety Pilot Program to award grants to specified school districts for a 2-year period, as specified. Existing law establishes the Nell Soto Parent/Teacher Involvement Program and the Tom Hayden Community-Based Parent Involvement Grant Program to provide grants to schools for specified purposes relating to parental involvement. Existing law states various findings and declarations of the Legislature relating to a nuclear age education curriculum.

This bill would repeal all of the above-specified provisions.

SECTION 1.  

Article 5 (commencing with Section 49350) of
2Chapter 8 of Part 27 of Division 4 of Title 2 of the Education Code

SEC. 2.  

Section 49550.2 of the Education Code is repealed.

49550.2.  

(a) The department shall conduct a study on or before
6March 31, 2007, on all of the following:

7(1) The number of schools that meet the qualifications for the
8federal severe need reimbursement, pursuant to subsection (d) of
9Section 1773 of Title 42 of the United States Code, that do not
10offer school breakfast.

11(2) The costs associated with requiring schools described in
12paragraph (1) to offer breakfast.

13(3) The feasibility of requiring the schools described in
14paragraph (1) to offer breakfast.

15(4) The changes that would need to be made to existing law, if
16any, to implement a program to require schools described in
17paragraph (1) to offer breakfast.

18(b) The department shall report the results of the study required
19pursuant to subdivision (a) to the Legislature on or before April
2030, 2007.

21(c) The department, at the discretion of the Superintendent, may
22contract for services required to complete the study required
23pursuant to subdivision (a).

24(d) Notwithstanding any other provision of law, for purposes
25of any contracts authorized pursuant to this section, the department
26is exempt from the requirements of Article 6 (commencing with
27Section 999) of Chapter 6 of Division 4 of the Military and
28Veterans Code and Part 2 (commencing with Section 10100) of
29Division 2 of the Public Contract Code.

SEC. 3.  

Article 2 (commencing with Section 51120) of Chapter
311.5 of Part 28 of Division 4 of Title 2 of the Education Code is
32repealed.

Article 4 (commencing with Section 51140) of Chapter
341.5 of Part 28 of Division 4 of Title 2 of the Education Code is
35repealed.
