An act to amend Section 43866 of the Health and Safety Code, relating to vehicular air pollution.

SB 1405, as introduced, Pavley. Alternative fuels.

Existing law requires, no later than June 30, 2007, the State Energy Resources Conservation and Development Commission, in partnership with the State Air Resources Board, and in consultation with specified state agencies, to develop and adopt a state plan to increase the use of alternative fuels, as defined.

This bill would make technical, nonsubstantive changes to those provisions.

The people of the State of California do enact as follows:

SECTION 1.  

Section 43866 of the Health and Safety Code is
2amended to read:

43866.  

Not later than June 30, 2007, the State Energy
4Resources Conservation and Development Commission, in
5partnership with the state board, and in consultation with the State
6Water Resources Control Board, the Department of Food and
7Agriculture, and other relevant state agencies, shall develop and
8adopt a state plan to increase the use of alternative transportation
9fuels.

P2    1(a) The plan shall include an evaluation of alternative fuels on
2a full fuel-cycle assessment of emissions of criteria air pollutants,
3air toxics, greenhouse gases, water pollutants, and other substances
4that are known to damage humanbegin delete health,end deletebegin insert health;end insert impacts on
5petroleumbegin delete consumption,end deletebegin insert consumption;end insert and other matters the state
6board deems necessary.

7(b) The plan shall set goals for the years 2012, 2017, and 2022
8for increased alternative fuel use in the state that accomplishes all
9of the following:

10(1) Optimizes the environmental and public health benefits of
11alternative fuels, including, but not limited to, reductions in criteria
12air pollutants, greenhouse gases, and water pollutants consistent
13with existing or future state board regulations in the most
14cost-effective manner possible.

15(2) Ensures that there is no net material increase in air pollution,
16water pollution, or any other substances that are known to damage
17human health.

18(3) Minimizes the economic costs to the state, if any.

19(4) Maximizes the economic benefits of producing alternative
20fuels in the state.

21(5) Considers issues related to consumer acceptance and costs
22and identifies methods to overcome any barriers to alternative fuel
23use.

24(c) The plan shall recommend policies to ensure alternative fuel
25goals are attained, including, but not limitedbegin delete to:end deletebegin insert to, all of the
26following:end insert

27(1) Standards on transportation fuels and vehicles.

28(2) Requirements, financial incentives, and other policy
29mechanisms to ensure that vehicles capable of operating on
30alternative fuels use those fuels to the maximum extent feasible.

31(3) Requirements, financial incentives, and other policy
32mechanisms to ensure that alternative fuel fueling stations are
33available to drivers of alternative fuel vehicles.

34(4) Incentives, requirements, programs, or other mechanisms
35to encourage the research, development, demonstration,
36commercialization, manufacturing, or production of vehicles that
37use alternative fuels.
