Existing law requires the Instructional Quality Commission, during the next revision after January 1, 2016, of the publication “Health Framework for California Public Schools,” to consider including comprehensive information for grades 9 to 12, inclusive, on sexual harassment and violence, as specified.

(a) When the “Health Framework for California Public
2Schools” (health framework) is next revised after January 1, 2017,
3the commission shall include comprehensive information for
4kindergarten and grades 1 to 8, inclusive, on the development of
5healthy relationships, which shall be age and developmentally
6appropriate.

(b) In including comprehensive information on the development
8of healthy relationships in the health framework, the commission
9shall comply with both of the following:

(1) Ensure information included in the framework is
11research-based and appropriate for pupils of all races, genders,
12sexual orientations, gender identities, and ethnic and cultural
13backgrounds. This may include, but shall not be limited to,
14reviewing other states’ curricula.

(2) Consult with secondary health teachers and experts in sexual
16harassment and violence curriculum.

SECTION 1.  

Section 33544 of the Education Code is amended
18to read:

33544.  

(a) When the “Health Framework for California Public
20Schools” (health framework) is next revised after January 1, 2017,
21the commission shall include comprehensive information on both
22of the following:

23(1) For grades 9 to 12, inclusive, on sexual harassment and
24violence that includes, but is not limited to, all of the following:

25(A) Information on different forms of sexual harassment and
26violence, including instances that occur among peers and in a
27dating relationship; a discussion of prevention strategies; how
28pupils report sexual harassment and violence; and potential
29resources victims can access.

30(B) Discussion of the affirmative consent standard, as defined
31in paragraph (1) of subdivision (a) of Section 67386, and skills
32pupils use to establish boundaries in peer and dating relationships.

33(C) Discussion of legal aspects of sexual harassment and
34violence under state and federal law.

35(2) For grades 1 to 8, inclusive, on the development of healthy
36relationships, which shall be age and developmentally appropriate.

37(b) In including comprehensive information on sexual
38 harassment and violence and on the development of healthy
39relationships in the health framework, the commission shall comply
40with both of the following:
