Existing law requires persons between 6 and 18 years of age, inclusive, to attend a public school within the school district in which the pupil’s parent or legal guardian resides, unless otherwise exempted. Existing law provides that a pupil complies with a school district’s residency requirements for school attendance in that school district if the pupil meets one of the specified requirements.

This bill would additionally provide that a pupil complies with a school district’s residency requirements for school attendance in that school district if he or she is a pupil whose parent is transferred or is pending transfer to a military installation within the boundaries of the school district while on active military duty pursuant to an official military order. The bill would require a school district to accept applications by electronic means for enrollment and course registration for those pupils. The bill would require the parent to provide proof of residence within 10 days after the published arrival date provided on the military order. By imposing new duties on school districts with regard to the review and acceptance of requests for school attendance by children of military personnel, the bill would impose a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the systems of public postsecondary education in this state.

(a) For purposes of this section, the following
4definitions apply:

(1) “Active military duty” means full-time military duty status
6in the active uniformed service of the United States, including
7members of the National Guard and the State Reserve on active
8duty orders pursuant to Chapters 1209 and 1211 of Title 10 of the
9United States Code.

(2) “Military installation” means a base, camp, post, station,
11yard, center, homeport facility for any ship, or other activity under
12the jurisdiction of the Department of Defense.

(3) “Parent” means the natural or adoptive parent or guardian
14of a dependent child.

(b) (1) Notwithstanding Section 48200, a pupil complies with
16the residency requirements for school attendance in a school
17district, if he or she is a pupil whose parent is transferred or is
18pending transfer to a military installation within the boundaries
19of the school district while on active military duty pursuant to an
20official military order.

(2) For purposes of this paragraph, a parent may use the
2military installation’s main billeting office address instead of a
3residential address.

(c) A school district shall accept applications by electronic
5means for enrollment, including enrollment in a specific school
6or program within the school district, and course registration for
7pupils described in subdivision (b).

(d) The parent shall provide proof of residence within 10 days
9after the published arrival date provided on the military order.

SECTION 1.  

Section 70900 of the Education Code is amended
16to read:

70900.  

There is hereby established the California Community
18Colleges, a postsecondary education system consisting of
19community college districts established pursuant to law and the
20Board of Governors of the California Community Colleges. The
21board of governors shall carry out the functions specified in Section
2270901, and local districts shall carry out the functions specified in
23Section 70902.
