Existing law creates the Los Angeles County Metropolitan Transportation Authority with specified powers and duties relative to transportation planning, programming, and operations in the County of Los Angeles. The authority is governed by a 14-member board of directors, including the Mayor of the City of Los Angeles, 2 public members and one Los Angeles city council member appointed by the mayor, 4 members appointed from the other cities in the county, the 5 members of the board of supervisors, and one nonvoting member appointed by the Governor.

This bill would expand the board of directors to 16 members by adding 2 members that reside in the County of Los Angeles, one member appointed by the Speaker of the Assembly and one member appointed by the Senate Committee on Rules and would prohibit these members from residing in the same city as another member of the authority, as specified.

By requiring the board membership to be expanded, the bill would thereby impose a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

Existing law, the Flood Control Law of 1946, authorizes, on a project-by-project basis, and in accordance with designated plans, state participation in federal flood control projects, and specifies the degree of cooperation to be assumed by the state and local agencies in connection with those projects. Existing law provides that the Legislature intends to pay from the General Fund for the construction of flood control projects adopted and authorized by the Congress of the United States, recommended by the Department of Water Resources, and approved by the Legislature.

The Los Angeles County Metropolitan Transportation
4Authority consists ofbegin delete 14end deletebegin insert 16end insert members, as follows:

5(a) Five members of the Los Angeles County Board of
6Supervisors.

7If the number of members of the Los Angeles County Board of
8Supervisors is increased, the authority shall, within 60 days of the
9increase, submit a plan to the Legislature for revising the
10composition of the authority.

11(b) The Mayor of the City of Los Angeles.

12(c) Two public members and one member of the City Council
13of the City of Los Angeles appointed by the Mayor of the City of
14Los Angeles.

15(d) Four members, each of whom shall be a mayor or a member
16of a city council, appointed by the Los Angeles County City
17Selection Committee. For purposes of the selection of these four
P3    1members, the County of Los Angeles, excluding the City of Los
2Angeles, shall be divided into the following four sectors:

3(1) The North County/San Fernando Valley sector.

4(2) The Southwest Corridor sector.

5(3) The San Gabriel Valley sector.

6(4) The Southeast Long Beach sector.

7The League of California Cities, Los Angeles County Division,
8shall define the sectors. Every city within a sector shall be entitled
9to vote to nominate one or more candidates from that sector for
10consideration for appointment by the Los Angeles County City
11Selection Committee. A city’s vote shall be weighted in the same
12 proportion that its population bears to the total population of all
13cities within the sector.

14The members appointed pursuant to this subdivision shall be
15appointed by the Los Angeles County City Selection Committee
16upon an affirmative vote of its members which represent a majority
17of the population of all cities within the county, excluding the City
18of Los Angeles.

19The members selected by the city selection committee shall serve
20four-year terms with no limitation on the number of terms that
21may be served by any individual. The city selection committee
22may shorten the initial four-year term for one or more of the
23members for the purpose of ensuring that the members will serve
24staggered terms.

25(e) If the population of the City of Los Angeles, at any time,
26becomes less than 35 percent of the combined population of all
27cities in the county, the position of one of the two public members
28appointed pursuant to subdivision (c), as determined by the Mayor
29of the City of Los Angeles by lot, shall be vacated, and the vacant
30position shall be filled by appointment by the city selection
31committee pursuant to subdivision (d) from a city not represented
32by any other member appointed pursuant to subdivision (d).

(f) Two members that reside in the County of Los Angeles, one
34member appointed by the Speaker of the Assembly and one member
35appointed by the Senate Committee on Rules. At the time a member
36is appointed pursuant to this subdivision, the member shall not
37reside in the same city as another member of the authority.

SECTION 1.  

Section 12803 of the Water Code is amended to
7read:

12803.  

The Legislature intends to make allocations from the
9General Fund for flood control projects to pay for the cost of all
10lands, easements, and rights-of-way necessary for the construction
11of flood control projects adopted and authorized by the Legislature
12prior to March 12, 1946, and also those adopted and authorized
13on or after that date by the Congress of the United States,
14recommended by the department, and approved by the Legislature,
15in the order in which the Congress makes available funds for the
16project’s construction.
