BILL ANALYSIS AB 645 ASSEMBLY THIRD READING AB 645 (Allen) - As Amended: January 31, 1994 ASSEMBLY ACTIONS: COMMITTEE PUB. S. VOTE 6-0 COMMITTEE W. & M. VOTE 16-0 DIGEST Under current law: 1) Any person, except those specified, who brings or possesses a firearm š upon the grounds or within any public school, without permission of specified school authorities, commits a felony punishable by one, two or three years in state prison. 2) Any person, except those specified, who brings or possesses a loaded š firearm upon the grounds or within any school, without permission of specified school authorities, commits a felony punishable by two, three or four years in state prison. 3) Any person who wilfully and maliciously discharges a firearm at an š inhabited dwelling house, occupied building, occupied motor vehicle, or other inhabited place is guilty of an alternate felony/misdemeanor punishable by three, five, or seven years in the state prison or by imprisonment in the county jail up to one year. This bill: 1) Repeals the existing provisions prohibiting firearms on school grounds. 2) Increases the length of incarceration in state prison for possession of š a firearm upon the grounds or within any school, as defined, without permission of specified school authorities, from one, two or three years in state prison to two, three or five years in state prison. 3) Increases the length of incarceration in state prison for possession of š a loaded firearm upon the grounds or within any school, as defined, without permission of specified school authorities, from two, three or four years in state prison to two, three or five years in state prison. 4) Provides that a person who, with reckless disregard for the safety of š another, discharges or attempts to discharge, a firearm upon the grounds or within any school, is punishable by imprisonment in the state prison for three, five or seven years. 5) Provides that the offenses listed in this bill would not require either š that notice be posted regarding the proscribed conduct. - continued - AB 645 Page 1 AB 645 FISCAL EFFECT According to the Ways and Means Committee analysis, unknown costs to local šlaw enforcement agencies to comply with this law. COMMENT According to the author: "I hosted a school safety hearing in November because of my š concern with increased violence on school campuses. Although š this bill was already on my legislative agenda, the hearing š fostered more support within my district for a zero-tolerance š policy against guns and weapons on school campuses. Crime is š placed at the top of the list of concerns in Orange County and my š constituents are demanding that this issue be adequately š addressed through tougher penalties for violent crime."
