BILL ANALYSIS AB 2268 CONCURRENCE IN SENATE AMENDMENTS AB 2268 (Caldera) - As Amended: September 1, 1993 ASSEMBLY VOTE 43-27 ( June 7, 1993 ) SENATE VOTE 21- š13 ( September 7, 1993 ) Original Committee Reference: TRANS. DIGEST Existing law prohibits a person riding a bicycle on a highway from šallowing a person four years of age or younger (or weighing 40 pounds or šless) to ride as a passenger without wearing a bicycle helmet. As passed by the Assembly, this bill: 1) Required any person under 18 years of age operating a bicycle or riding š as a passenger on a bicycle to wear a bicycle helmet when riding on public property. 2) Required all bicycle helmets sold to meet specified safety standards š and to be conspicuously labeled. 3) Provided the following penalty provisions applicable, as appropriate, š both to bicycle riders and persons selling helmets: a) In 1994, only warnings and no citations would be issued. b) Thereafter, violations would be punishable as an infraction, with a specified fine (not including penalty assessments) of $25. c) Parents and legal guardians having control or custody of an unemancipated minor would be jointly and severally liable for the fine with the minor. d) Requires a court to dismiss a charge if the person cited alleges that the charge is the person's first violation of the bicycle helmet law. 4) Provided that fine revenues from bicycle helmet citations shall be made š available to counties for bicycle safety education and for assistance to low-income families for purchasing helmets. The Senate amendments: 1) Provide that the fine for a bicycle helmet violation (beginning in š 1995) shall be not more than $25, rather than specifically $25. 2) Limit the amount of fine revenue available for administrative purposes š related to helmet distribution to low-income families to 2 1/2 percent. - continued - AB 2268 Page 1 AB 2268 FISCAL EFFECT Unknown COMMENTS The Senate amendments were minor.
